BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: April 7, 2015 TO: Honorable Chairman and Members of the Board FROM: Jeff Littrell SUBJECT: Resolution to Authorize Water & Sewer Director or Designee to Execute CEC Agreements DEPARTMENT: Water and Sewer BCC DISTRICT: All STATEMENT OF ISSUE: Staff requests approval and execution of a resolution, which relates to the designation and execution of Capacity Expansion Charge (CEC) Purchase Agreements by “the Water and Sewer Director or his/her designee”. The CEC Purchase Agreement provides property owners connecting to the County’s water and/or sewer system the ability to make agreed upon scheduled CEC payments with the monthly utility bill. BACKGROUND: Each new water and sewer connection to the County system requires a Capacity Expansion Charge (CEC) that is collected in advance of the issuance of a building permit unless otherwise specified by an acquisition agreement. The current Capacity Expansion Charge for a ¾” water meter at a single residential unit is $800 for water and $3,200 for sewer. CECs are fully outlined in the Okaloosa County Ordinance, Sec. 24, Appendix A. The purpose of a CEC is to account for the cost of providing water supply capacity and wastewater treatment/disposal capacity needed to serve each new connection. There are various instances in which customers are required to connect to our water and/or sewer system, per County Ordinance or State Statute. For example, property owners who are being supplied with water or sewer services through a private well and/or septic tank located on the property may become required to connect to the County’s system. These property owners are allowed to enter into a Purchase Agreement with an installment plan for payments. Water & Sewer staff recently requested our County Attorney to review the CEC Payment Plan that had been approved by the previous County Attorney for possible additions, deletions, or revisions. Upon review of the current form by the County Attorney, a recommendation was made to adopt a new Okaloosa County Capacity Expansion Charge Purchase Agreement form, along with a resolution (drafted by his staff). The proposed resolution designates and authorizes the Water and Sewer Director, or his designee, to execute CEC Purchase Agreements with customers, to be agreed upon on a case-by-case basis. OPTIONS: Approve or deny. RECOMMENDATIONS: Staff recommends BCC approval to authorize the Chairman to execute a resolution that designates and authorizes “the Water and Sewer Director or his/her designee” to execute Capacity Expansion Charge Purchase Agreements with customers. RECOMMENDED BY: APPROVED BY: John Hofstad, County Administrator
