READING P. + 1st hi- 2nd2nd ORDINANCE 2035 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FORT WALTON BEACH, FLORIDA; AUTHORIZING THE DISPOSITION OF REAL PROPERTY ON HOSPITAL ROAD, DESCRIBED HEREIN, TO OKALOOSA COUNTY AND AUTHORIZING AND DIRECTING CLOSURE BY THE MAYOR, CITY MANAGER, CITY ATTORNEY, AND CITY CLERK; AND PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WALTON BEACH, FLORIDA AS FOLLOWS: WHEREAS, the City of Fort Walton Beach currently owns an 11. 97- acre parcel with a primary address of 1127 Hospital Road, Fort Walton Beach, Florida which is currently occupied by Liza Jackson Preparatory School; WHEREAS, the property is part of a larger parcel conveyed to the City of Fort Walton Beach from United States of America with certain restrictive conditions on the use of the property; WHEREAS, on April 28, 2020, City Staff received a traffic study from Southern Traffic Services as part of the development and construction of Liza Jackson Preparatory School facilities on the City' s property; WHEREAS, the traffic study found that an additional lane on Hospital Road would benefit the intersection during non- school periods; WHEREAS, Hospital Road is an Okaloosa County maintained roadway and requires that, for construction of the additional lane, the City provide approximately 0. 13 acres of property to Okaloosa County as a public right-of-way; WHEREAS, Okaloosa County has requested the 0. 13 acres be deeded to the County and they will officially dedicate the land as a county right-of-way; and WHEREAS, City Staff has confirmed with Eglin Air Force Base that the proposed use and conveyance of the 0. 13 acres of property at 1127 Hospital Road is proper and a lawful use of the property. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WALTON BEACH, FLORIDA AS FOLLOWS:  Section 1. Authority & Intent The authority for enactment of this ordinance is contained in Section 2.00.05 of the Code of Ordinances. The City intends to transfer City-owned property to Okaloosa County for use as public right-of-way. The City has no future need for the property. The property is a 0. 13- acre portion of the parcel currently being developed for the Liza Jackson Preparatory School and is currently listed as a portion of Parcel ID No.' s 34- 1S- 24-0000- 0029-0010 and 34- 1S- 24- 0000- 0029- 0000, with a property address 1127 Hospital Road. Section 2. Property Description COMMENCE AT THE GOVERNMENT LAND OFFICE ( GLO) MONUMENT MARKING THE SOUTHEAST CORNER OF THE NORTHEAST QUARTER OF SECTION 34, TOWNSHIP 1 SOUTH, RANGE 24 WEST, OKALOOSA COUNTY, FLORIDA. Disposition of City-Owned Property The disposition of the City- owned property at 1127 Hospital Road will occur via recording of a Warranty Deed. Section 4. Findings The City Council of the City of Fort Walton Beach, Florida, finds that the transfer of the parcel is made based upon utilization of the property and development for uses benefiting the public.  Section 5.
