Meams, City Manager From: Michael Beedie, Engineering & Utility Services Director Date: September 13, 2011 Subject: MPB Case # 11 - 07 -SP Waste Management Site Plan 1. BACKGROUND: I. I. Goodwyn, Mills, and Cawood, htc., the authorized agent for Waste Management, Inc., submitted a Site Plan application for approval of a storage yard at 109 Ready Avenue NW. The proposed site is 13. 59 acres. 1. 2. Section 13. 21 of the Land Development Code outlines the process for a major development review. Subsection 13. 21. 3( D) Review Process, Major Development, defines " any development involving 2. 26 acres or more of development area" as subject to the major development review process, which requires Site Plan approval by City Staff, the Municipal Planning Board, and City Council. If approved, the development is issued a development order (DO). 1. 3. The attached Municipal Planning Board ( MPB) staff report contains all of the project information as well as a complete analysis of the proposed project as it complies with the City' s Land Development Code. 2. DISCUSSION: 2. 1. At the time the MPB staff report was written and posted, the applicant' s proposed project did not contain enough information to demonstrate compliance with Sections 14. 90, Stormwater Management, and 16. 30. 13, ADA- designed parking spaces, of the Land Development Code. At that time, staff recommended denial of the application, based on those findings. 2. 2. On August 30, 2011, the applicant submitted a revised Site Plan and Stormwater Management Plan to the City which demonstrated compliance with the City' s Land Development Code. 2. 3. During the public hearing at the Municipal Planning Board / Local Planning Agency regular meeting on September 1, 2011, the revised Site Plan was entered into the record. Staff recommended approval of the revised Site Plan and the Local Planning Agency unanimously recommended approval of the revised Site Plan. 3. FINANCIAL INFORMATION: 3. 1. There is no direct financial impact from this item. 4. RECOMMENDATION: 4. 1.
