SHAW WALTER J. SMITH 1929-2001 * ALSO ADMITTED IN ALABAMA April 22, 2014 Honorable Wayne Harris Board of Okaloosa County Commissioners 302 N. Wilson Street, Suite 302 Crestview, FL 32536 RE: Right of Way Abandonment Dear Mr. Harris: Our client, Gary McMorrow is the owner of Lot 2, Block 9 in Oakdale Miniature Farms. The lot is located at 1001 Industrial Drive. The lot once bordered Railroad Street; a 50' right of way used as an access road that ran parallel to the L&N train tracks; a 100' right of way. See attached plat. Following the demolition of the tracks and subsequent installation of Industrial Boulevard, use of Railroad Street was eliminated. We respectfully request that Okaloosa County consider abandoning that section of Railroad Street that is contiguous to our client’s western lot line so that he might improve it and maintain it. Currently, the strip of land between the western lot line and the edge of Industrial Boulevard, which includes Railroad Street, is approximately 85 feet wide. Once Railroad Street is abandoned, the existing utility corridor, a strip of land approximately 35 feet wide, will still be available to the City and the County for future road improvements, utilities and drainage. Furthermore, since a sufficient amount of land will remain after said abandonment to accommodate utility lines, drainage and future road and intersection expansion, We respectfully request that Okaloosa County abandon the right of way without any conditions limiting the use of said land that is returned to Mr. McMorrow; except those conditions and limitations that might be imposed through the normal development process. Honorable Wayne Harris April 22, 2014 Page 2 Finally, it is our understanding that the County has already granted similar requests to the owners of Lot 3, adjacent south of Lot 2 and Lot 1 adjacent north of Lot 2. Thave attached a copy of a survey of the lot showing Industrial Drive and it's relation to Mr. McMorrow’s lot. I have also attached the plat mentioned above. Your timely attention to this matter would be greatly appreciated. Very truly yours, Richard P. Petermann
