BOARD OF COUNTY COMMISSIONERS
AGENDA REQUEST
DATE: March 17, 2015
TO: Honorable Chairman and Members of the Board
FROM: Elliot Kampert
SUBJECT: Approval of Regatta Bay Preserve Planned Unit Development
DEPARTMENT: Growth Management
BCC DISTRICT: District 5 - Kelly Windes
ISSUE: Consideration of a request for Regatta Bay Preserve Planned Unit Development (PUD),
a proposed 21 lot single family detached residential subdivision as submitted by Tom Patton,
agent on behalf of the property owner, Emerald LTA-2 LLC. The property is currently zoned
Residential - 2 (R-2) with a Future Land Use Map (FLUM) designation of Medium Density
Residential (MDR). A general location of the property is south of Commodore Point
Subdivision, west of Emerald Lakes Phase III Subdivision, Destin. Property contains 15.97 acres
more or less.
BACKGROUND: The proposed 21 lot Planned Unit Development (PUD) single family
detached residential subdivision was submitted on 11/4/14 and heard by the Planning
Commission on December 11, 2014. Due to numerous inconsistencies with the design standards
specified in the Land Development Code and not enough time to work out the issues, the
Planning Commission tabled the item to February 12, 2015. The previous submittal had four (4)
deviations from Land Development Code in order to achieve a Neo-Urban design and sense of
community. The revised site development plan was submitted on January 2, 2015 with five (5)
additional deviations from the LDC the applicant is requesting the Board to approve as follow.
• Building Setbacks - The PUD proposed 5’ front, 0 sides, and 0 rear setbacks but will
maintain 10’ distance between house structures.
The Planning Division has no objections to the requested building setbacks. The
separation requirements of the building, fire and life safety code shall apply.
• Cul-de-sac ROW diameter and pavement width - From 110’ ROW diameter and 100’
pavement width to 80’ ROW and 72’ pavement including curbing.
The Destin Fire Control District approved the site development plans and does not have
any objection on the cul-de-sac right of way diameter and pavement width as requested.
• Wetland Buffer - In addition to comply with the intent of the Comprehensive Plan by
routing the stormwater from developed areas, a variable buffer has been provided with an
average width of 16.45’ instead of 25’ measured from the wetland line.
Planning staff has no objection to the average width of 16.45’ instead of 25’ measured
from the wetland line as requested. The subdivision has been designed to not have an
overland run-off from developed areas. Instead, all stormwater will be routed to the
retention facilities within the development. The existing wetlands areas within the project
boundary consisting of 6.79 acres will be preserved as noted on the site plan.
• Minimum of 15’ access way around the retention/detention areas for maintenance
purposes -Retention ponds will be privately maintained and access will be provided to the
ponds through the road right of ways and common areas for maintenance and repairs.
The Public Works Department has no objections to the proposed development provided
the Board approves all proposed deviations from the Land Development Code (LDC).
• Wet detention pond perimeter fence - In order to maintain the aesthetic appeal of the
pond, a 6’ wide boardwalk is proposed in order to provide a dock-like feel around the
northern portion of the pond. The southern portion that abuts the wetland areas will not
be accessible by the general public.
Public Works has approved the site development plans with the stipulation that the Board
approve the proposed deviations from the LDC.
• Wet detention pond is not proposed to have a 3:1 slope along the northern retaining wall
and dock like boardwalk to maintain the water depth along the boardwalk even when the
water table is low for aesthetic appeal.
Public Works has approved the site development plans with the stipulation that the Board
approve all proposed deviations from the LDC.
• Roadway pavement width of 10’ per lane - The PUD proposes a 9’ wide pavement width
per lane with an 18” valley curbing for a total of 21’.
Public Works has approved the site plans with the stipulation that the Board approve all
proposed deviations from the LDC.
The Destin Fire Control District has no objection to the requested pavement width. The
roadway width as proposed will be adequate for Fire District response as stated in
emails from the District dated 11/26/14 and 1/26/15 on file with the Planning Division.
• As required by Section 6.03.06 of the LDC, the proposed right-of-way (ROW) provides
the minimum 25’ required; however, the ROW does not include the 7.5’ drainage and
utility easement as required by the Code. There will be no drainage swales located along
the road side; instead a curb and gutter drainage system is proposed. Easements will be
provided for utilities, but in smaller width from the required 7.5’.
Gulf Power and South Walton Utilities have no objection to the proposed ROW. As these
are to be privately maintained roads, the other utilities have stated they will work with
the developer.
• The cul-de-sac turn-around dimension for the ROW and pavement diameter is less than
dimensions provided by the American Association of State Highway and Transportation
Officials (AASHTO).
The Destin Fire Control District has no objection on the request as presented. The
roadway width and the cul-de-sac turn around will be adequate for Fire Department
response.
There has been no public comment or opposition as of the date of this writing (3/9/15).
The Planning Commission voted unanimously to recommend approval at a public hearing held
February 12, 2015. The Military Representative on the Planning Commission had no comments.
OPTIONS: The Board may approve, approve with conditions, or deny the PUD request.
RECOMMENDATION: Staff recommends approval of the PUD request.
