He says this contract needs to go out for bid and that to get the invoice paid, it will have to go to the Board for approval. Although the original agreement states language that Jack and I interpreted as indefinite, Greg's decision is based on the date typed in "09/30/2007". Upon further review of our hard file I found an Exhibit B form submitted by John Christopher on 1/18/2006 that indicates "EXPIRES INDEFINITE" in the term space. The initial label affixed to the contract signed on 1/18/2006 shows an expiration date of 9/30/2006. Then there is another agreement that was signed on 8/8/2006 that updated the commence date from "CALL" to 10/01/2006 and the language under the "Additional Information" section. The label affixed to this agreement states "INDEFINITE" and had the " ... and will continue until terminated upon 30 days ... " highlighted. Which would indicate that John converted this to an indefinite contract based on that language and it has been maintained as indefinite. During that time neither party has given written notice to terminate. Hope this helps. Today, we received a pay request under the Addendum/Amendment/Renewal to contract, C06-1315-TDD and cannot approve. How can the agreement Addend/Amend/Renew without a "Renewal" or Modification to extend the original agreement that expired 9-30-2007? We have attached the FYE 9-30-2006 Agreement from our file along with the 9-30-2007 FYE Agreement. Our file began with the C06-1315-TD1-73 agreement signed by Richard B. 1-18-2006, with an expiration of 9-30- 2006; annual renewal. 2. The same agreement on the Purchasing site has a different label and indicates Indefinite. 3. We also have in our file C06-1315-TD2-73 agreement signed by Richard B. 8-8-06, with an expiration of 9-30- 2007; annual renewal. We have no record of any renewal past 9-30-2007 and we have no record to close the file from Purchasing. How can we process this new Addendum/Amendment/Renewal as Indefinite without a change in the terms, when the last original on hand reads Expires 9/30/2007-Annual Renewed?
