required. Mr. Villani said last year the funds were
appropriated but there was no agreement in place to aliow for
the disbursement. He pointed out that Section 4.3 states this
agreement is completely dependent upon appropriation of legally
available funds by Okaloosa County and in the event such funds
are not appropriated for any reason, the agreement shall
terminate and be considered void.
Mr. David Sherry, Okaloosa Island, suggested the commissioners
Gelay any action because the season is over. Regardless of the
earlier statement regarding availability of funds, Mr. Sherry
felt the county would still be obligated to make payment if it
were determined use of TDC funds for this expense is deemed
illegal. He said if it is determined this is not an allowable
use of the TDC funds, he does not believe the money will be
returned by the Destin Fire Control District. Mr. Sherry
questioned it being the responsibility of the Board of County
Commissioners to fund lifeguards in the City of Destin, noting
the county would have no jurisdiction over them.
With regard to jurisdiction over the Destin beaches, Mr. Dowd
stated if the county’s ordinance is more stringent than the
city’s, then the county’s regulations have jurisdiction. He
added the Board is treating both the citizens of Destin and
Okaloosa Island in a similar fashion.
Mr. Windes remarked that people drown in the off season. He
Said he trusts the department head and the attorneys. Mr.
Windes then made motion, seconded by Mr. Harris, to approve the
interlocal agreement as presented. 4 yeas. (Mr. Parisot was
