BOARD OF ADJUSTMENT GOALS FOR COUNCIL' S STRATEGIC PLANNING SESSION FOR JANUARY 22, 2005 AT FORT WALTON BEACH LIBRARY Board of Adjustment discussed at the 12- 16- 04 meeting - Board has no Comments or issues to submit to Council CODE ENFORCEMENT BOARD GOALS FOR COUNCIL' S STRATEGIC PLANNING SESSION FOR JANUARY 22, 2005 AT FORT WALTON BEACH LIBRARY Code Enforcement discussed at the 12- 8- 04 meeting - Board has no Comments or issues to submit to Council Code Enforcement Board meeting 12- 8- 04 3- RULES conl Mr. Lorenz mentioned there is a provision in the civil rules that provides for a motion for re- hearing and suggested, for the Board' s consideration, that a provision be placed in Order II that says they have a right to request a reduction of a fine, but they must file a written request within ten days of the order and they must appear before the Board, and also place a disclaimer that says it does not affect the 30 days they have to file an appeal under Florida Statutes. He said that will let staff know who will ask for a reduction within ten days after the date of the Order. The City Attorney commented putting a shorter time frame would protect the City' s rights as well as the citizen' s rights. The CDS Director commented that placing it in the Order would let the citizens know the procedure. Mr. Lorenz stated it should be clear when they file the request for a reduction of the fine that the Board will not re- hear the case. Mr. Rettie expressed his concern that ten days is too short a time. The CDS Director expressed if ten days is typical in other cases, then it is reasonable. She said if someone is serious, they will know in ten days if they want to request a fine reduction and then it will go to the Board at the next meeting, which will actually give the person 30 days to prepare. Mr. Lorenz stated if there has been no written request for reduction of fine within the ten days, then staff will record the lien. Mr, Horn expressed agreement with Mr. Lorenz' s suggested solution, Mr. Lorenz suggested placing a precautionary statement in Order I also. Mr. Rettie moved to amend the motion that the Code Enforcement Board Rules be amended to allow ten days for respondent to request a fine reduction from when Order II is signed, and if a fine reduction has not been requested within ten days, then staff will immediately file Order II as a lien; further, language on the ten days to request a fine reduction will be placed in both Order I and Order II, along with a disclaimer that advises of the 30 day Notice of Appeal period to the Court, per State Statute. Ms. Sanders accepted the motion as amended and it carried unanimously with Connelly, Faccini, Horn, Palkowski, Rettie, Sanders, and Scott in favor (Edmonston absent). Mr. Rettie withdrew discussion on foreclosure proceedings for this evening. COUNCIL STRATEGIC PLANNING SESSION Strategic Planning Session - Comments to Council. The CDS Director stated Council has a Strategic Planning Session scheduled for January 22nd to look at issues they want to accomplish in 2005.
