neighborhood. He said he is opposed to giving the applicant
more time. Mr. Welch stated it is not necessary to destroy a
neighborhood to install this tower. Mr. Amunds asked Mr. Welch
if he wants the Board to make a decision today rather than give
Crown Castle an opportunity to try to locate the tower at the
park. Mr. Welch proposed the Board just tell them “no.”
Mr. Paul Wargo, Lido Circle, presented a diagram and explained
where his home is located in relation to the proposed tower
site. He said the entire tower will be exposed from his
location. Mr. Wargo stated the residents take pride in their
community, pointing out there are no telephone poles or overhead
lines.
Mr. Boyles asked for clarification on what direction is to be
taken. He expressed concern the position taken should be
legally defensible. Mr. Boyles stated a 90-day extension has
been requested and if a decision is made today, it better be
done the right way. He said he does not want to rush into this
and have an appeal on the backside.
Mr. Dowd said along those lines he would like to ask the
Bluewater Bay residents if they want to be duplicitous. He said
this will probably be back before the Board in 90 days and the
residents’ comments would be fresh in the commissioners’ mind at
that time.
Mr. Floyd Libell, Rock Cove Subdivision, stated he is not
pushing for a decision today. He said the homeowners would like
more time to prepare.
Ms. Westine stated she would like to speak very candidly and
advised that she is not prepared to go forward with a full
hearing today. She advised that she called off her witnesses
and her only request today is for a 90-day continuance.

Okaloosa County Board of County Commissioners
Mr. Thaddeus Wallace, representing the Magnolia Forest
Homeowners Association, thanked the Chairman for his
recommendation at the initial hearing for Ms. Westine and Crown
Castle to meet with the residents. He said that he contacted
and met with Senator Gaetz the Director of Parks and Recreation.
Mr. Wallace stated he learned location of the tower at Fred
Gannon State Park is very much possible but there is a process.
He felt if the Board would submit a letter of support for that
process, it would be helpful. Mr. Wallace said he spoke with
Mr. Dudley, Crown Castle representative, and was able to confirm
Crown Castle has begun the application process to locate the
tower at the park. ‘He stated they will help them in the process
and believes the 90-day extension will allow time to find a
suitable tower location at the park.
Mr. Jack Brooks, Lido Circle, stated his neighborhood does not
have a homeowners association. He expressed concern about what
Girection will be taken. Mr, Brooks questioned what he
perceived to be the Board’s support for the tower at the first
hearing because it would support emergency services
communications. He said his research shows the towers can be
further apart and he believes it is not necessary for the tower
to be that tall.
Mr. Jerry Mallory, representing the Royal Oak Villas Homeowners
Association, said he believes the 90-day request is worth
considering.
Mr. Amunds closed the public comment period and brought the
discussion back to the Board.
Mr. Windes said he believes it is in the best interest of
everyone involved to grant the 90-day continuance. Mr. Windes
made motion, seconded by Mr. Parisot, to approve the 90-day
continuance requested by Ms. Westine and to endorse a letter
supporting the application process for location of the tower at
Fred Gannon State Park. Mr. Parisot suggested letters from the
Chairman be sent to: all state agencies involved in this proceed.
Mr. Boyles stated the applicant is not ready to process today
and if the Board did go forward, there would probably be an
appeal which would result in a court case. Mr. Harris voiced
support of the motion. 5 yeas.

PUBLIC HEARING -—- PURCHASE OF PROPERTY ENCOMPASSING SHERIFF'S
FIRING RANGE :
Mr. Stanford read the advertised legal notice for public hearing
to consider the purchase of property encompassing the Sheriff’s
Firearms and Tactical Training Facility, or firing range, plus
additional property encompassing 8.91 acres.
Undersheriff Don Adams advised he is present to answer any
questions, noting that he has already talked to each
commissioner individually regarding the wisdom of this purchase.
He stated all steps in the process have been taken, including
the securing of an affidavit from all property owners and
obtaining three proposals for a survey.
Mr. Dowd stated he believes there is compliance with all
statutory requirements. He said the Board’s decision is now
whether or not to proceed and how many acres to purchase. Mr.
Amunds responded that he supports the purchase of the larger
tract consisting of 8.91 acres for $89,900. Undersheriff Adams
stated the property will be purchased with seized drug money and
owning the parcel will provide an opportunity to make long-term
improvements. Upon inquiry by Mr. Dowd, Undersheriff Adams
Stated the Sheriff’s Office will make the purchase and then deed
the property to the county.
No one came forward to speak in favor of or in opposition to the
proposed purchase. Mr. Harris made motion, seconded by Mr.
Boyles, to purchase the 8.91 acres encompassing the firing range
for $89,900. 5 yeas.
SHERIFF — REQUEST TO CARRY FORWARD $300,000 FROM FY 2013 FOR
AMMUNITION PURCHASE
Undersheriff Adams explained funds were encumbered in the FY
2013 budget for ‘the purchase of a three-year supply of
ammunition. However, the delivery was not made prior to end of
the fiscal year. He requested $300,000 be carried forward and
allocated for the ammunition purchase. A lengthy discussion
ensued. Mr. Stanford clarified these funds were encumbered in
FY 2013 and could not be spent. The unspent funds will be
remitted back to the BCC. A budget amendment would then be
prepared transferring the funds to the Sheriff’s Office for the
ammunition purchase. Mr. Harris made motion, seconded by Mr.
Parisot, to approve the request. 5 yeas.

CONSENT AGENDA APPROVAL
Mr. Parisot requested Item #17 be pulled for discussion.
17. Tourist Development: Approval of and authorization for
Chairman to execute amendment and renewal of contract with
Horizons for cleaning services for county parks bathrooms
Mr. Parisot questioned the contract as it was written which
provides the Tourist Development Council (TDC) as the monitoring
entity. He felt this should be changed to the county’s Parks
Division. Mr. Amunds pointed out that it is TDC funds and asked
why TDC should not have oversight. He acknowledged the county
Parks Division is called out when there are problems/repairs at
the parks. When asked for comment, Mr. Dowd stated it is a
benefit to the tourist development district so he believes the
purpose is valid in that regard but does not think it is
decisive. Mr. Boyles said his understanding is TDC approves the
annual expenditure and beyond that point service and oversight
is by the Parks Division. He asked if he is missing something.
A lengthy discussion ensued. Mr. Hofstad said he believes the
discussion is about administration of the contract. He stated
funding oversight is by the TDD, adding there is no problem from
the Public Works Department perspective because the Parks
Division monitors the parks any way. He felt this to be a legal
item. Mr. Amunds said it was his understanding Mr. Parisot
wanted to move the funding from TDC to Parks. Mr. Dowd asked if
a budget transfer is required. Mr. Stanford explained TDC does
not fund the entire thing, saying General Fund dollars also fund
the parks. He said it is a matter of procedure or authorization
as to who is in control of the contract. Mr. Parisot renewed
his position that administration of the contract should be with
the Parks Department. Mr. Boyles asked what is broken with the
current system.
Mr. Daniel O’Byrne, TDD Director, stated management issues have
been addressed. Previously, money for the bathrooms was in the
second and third pennies but has been moved into the first penny
and Jim Trifilio is in charge of that. Discussion continued.
Mr. Richard Brannon, Purchasing Director, stated it is no
problem to change who monitors the contract. Mr: Boyles made
motion, seconded by Mr. Windes, to approve the amendment and
renewal of the contract with Horizons for cleaning services of
