BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: November 1, 2016 TO: Honorable Chairman and Members of the Board FROM: Roland Sims Jr. SUBJECT: Public Hearing Request - Adoption of an Ordinance Amending the Bluewater Bay MSBU DEPARTMENT: County Administrator BCC DISTRICT: 5 STATEMENT OF ISSUE: In 2002, the Board adopted an Ordinance pursuant to the provisions of section 125.01(1) q, Florida Statutes which created the Bluewater Bay Municipal Service Unit (the “MSBU”). The purpose of the Unit was to provide for the funding of improvements and services that specifically benefit properties within the unit. The original ordinance was amended earlier this year to bring the ordinance in line with current law and practice. The Board of the MSBU has requested an amendment to the Ordinance to establish a process where a waiver of insurance requirements can be accomplished in those circumstances that a particular type of insurance is unnecessary. BACKGROUND AND ANALYSIS: The Board of the Bluewater Bay MSBU has requested an amendment to the Ordinance to establish a process where a waiver of insurance requirements can be accomplished in those circumstances that a particular type of insurance is unnecessary. More particularly, the proposed revisions provide a mechanism for the MSBU Board to seek a waiver of the insurance requirements from the obtaining of property insurance or workers compensation coverage if it can demonstrate to Risk Management and the County Administrator that it does not have any property and or employees that would be covered by such policies. Staff and representatives of the County Attorney’s office have met with members of the Bluewater Bay Municipal Services Benefit Unit Board to discuss these issues and the Board has voted to request the proposed amendment. Staff requests authorization to schedule and advertise a Public Hearing for the adoption of the amendment to the Ordinance. Staff would request that the public hearing be scheduled for the Boards November 15, 2016 meeting at the County Administration Building in Shalimar. OPTIONS: Approve/Disapprove. RECOMMENDATION: Authorize the scheduling and advertising of a public hearing to be held at the Board’s November 15, 2016 meeting for the consideration of an ordinance amending the Bluewater Bay Municipal Services Benefit Unit Ordinance.
