the Business Associate Agreement with ADPI. The HIPAA Rule is a set of federal standards to
protect the privacy of patients' medical records and other health information maintained by
covered entities. These standards provide patients with access to their medical records and with
significant control over how their personal health information is used and disclosed. In addition
to updating the HIPAA Rule, the amendment also states that patient accounts will be turned over
to the collection agency after 180 days if no collection has been made unless insurance payment
is pending. Currently, the accounts are turned over to the collection agency after one year. If the
collections agency makes contact with patients and they have medical insurance, after one year it
is too late to file a claim with most insurance companies.

BOARD OF COUNTY COMMISSIONERS
AGENDA REQUEST
DATE: September 17, 2013
TO: Honorable Chairman and Members of the Board
FROM: Dino J. Villani
SUBJECT: Amendment to Teen Court Agreement with Lutheran Services Florida,
Inc.
DEPARTMENT: Public Safety
BCC DISTRICT: All
STATEMENT OF ISSUE: Request approval of the amendment to the agreement with Lutheran
Services Florida, Inc., to provide a pretrial diversion program for teenagers (Teen Court), which
renews the contract for one (1) additional year from October 1, 2013, through September 30,
2014.
BACKGROUND: Teen Court is a diversion program for youthful offenders, which offers the
authority of the adult judicial system through the voices and actions of other youths under adult
supervision. Local attorneys donate their time as mentors and provide judicial oversight for the
court sessions, but the hearings are predominately run by teen volunteers and offer youthful
offenders an opportunity to face a jury of their peers for appropriate sentencing and sanctions.
During the period of July 2012-June 2013, the Teen Court program processed 188 court cases
with 272 youth volunteer hours and 428 adult volunteer hours, representing $12,193.50 in youth
and adult dollars saved through in-kind services.
In accordance with the fee structure enacted by the Board (Ordinance 04-16, Section (1)(a)(4),
and a review of past and projected collections, the county should have sufficient revenue to
support the proposed Fiscal Year 2013-14 budget of $85,000.00.
OPTIONS: Approve or disapprove.
RECOMMENDATIONS: Approve and authorize the Chairman to execute the amendment to
the agreement with Lutheran Services Florida, Inc., for the Teen Court program for Fiscal Year
