Agreement that it is not intended by any
of the provisions of any part of the Agreement to create in the public or any member thereof, a

third party beneficiary under this Agreement, or to authorize anyone not a party to this Agreement
to maintain a suit for personal injuries or property damage pursuant to the terms or provisions of
this Agreement. '
Section 17. Waiver of Performance
The waiver by either Party of performance of any provisions of this Agreement shall not constitute
a future waiver of performance of such provisions.
Section 18. Severability
[f any provision of this Agreement or the application thereof to any person, entity or circumstance,
shall, to any extent, be invalid or unenforceable, the remainder of this Agreement shall not be
affected thereby, and each other provision of this Agreement shall be valid and be enforceable to
the full extent permitted by law.
Section 19. Assignments, Independent Contractors
All terms pertaining to assignments, notice requirements, and independent contractors as set forth
within C15-2323-GM, which may be amended from time-to-time, are applicable to this
Agreement.
