FILE #3533335 RCD: 3/ 10/ 2022 12: 15 PM, BK: 3609 PG: 2024, RECORDING: 515. 00 RECORDING ARTICLE V: 512. 00 DEPUTY CLERK ASECRIST JD PEACOCK 11 CLERK OF COURTS, OKALOOSA COUNTY, FLORIDA ORDINANCE 2094 t WHEREAS, on January 18, 2022, the Growth Management Department received an application for voluntary annexation of property located at 201 Lovejoy Road NW into the City limits of Fort Walton Beach, Florida; WHEREAS, 201 Lovejoy Road NW is currently a vacant lot; WHEREAS, Chapter 174. 044 & 174. 043 of the Florida Statutes dictates the process for voluntary annexations and provides the criteria for a property to be considered for annexation; and WHEREAS, Staff has conducted an analysis of the 201 Lovejoy Road NW property pursuant to the criteria outlined in Florida Statutes and has determined that the necessary annexation criteria are net to legally annex the property into the City of Fort Walton Beach, Florida. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WALTON BEACH, FLORIDA: Section 1. Authority and Intent The authority for enactment of this ordinance is contained in Chapter 166. 021( 1) and 171. 044 of the Florida Statutes, and Section 2 of the City Charter. Section 2. Findings of Fact The City Council of the City of Fort Walton, Beach hereby finds the following: The City received an application for voluntary annexation from Choctaw Engineering, Inc., on behalf of the owner, Props Craft Brewery, LLC. The applicant has provided sufficient evidence of ownership of said property to be annexed. The subject property is contiguous to the municipal boundaries of the City of Fort Walton Beach, is an area that is reasonably compact, and is unincorporated territory. The annexation of subject property will not result in the creation of any enclaves. The notice of annexation was duly published once a week for two consecutive weeks in the Northwest Florida Daily News, a newspaper published within the City of Fort Walton Beach. Upon adoption, this ordinance will be filed with the Okaloosa County Clerk of Court, the Okaloosa County Administrator, the Ocean City -Wright Fire Control District, Okaloosa County Property Appraiser, Okaloosa County 'rax. Collector, and the Florida Department of State. BK: 3609 PG: 2025 Section 3. Property Annexed The following described property is hereby annexed into the City of Fort Walton Beach: 201 LOVE30Y ROAD NW: PARCEL ID 09 -2S -24- 244A- 0001- 0010 LOT I AND 2, BLOCK 1, SYLVANIA HEIGHTS SUBDIVISION, ACCORDING TO THE PLAT THEREOF, RECORDED IN PLAT BOOK 2, PAGE 48, OF THE PUBLIC RECORDS OF OKALOOSA COUNTY, FLORIDA. TOGETHER WITH THE NORTH 1/ 2 OF THE THAT PORTION OF THE VACATED RIGHT OF WAY OF LOVEJOY ROAD LYING SOUTH OF AND ADJACENT TO LOTS I AND 2, BLOCK 1, SYLVANIA HEIGHTS SUBDIVISION, AND NORTH OF RIGHT OF WAY LINE OF LOVEJOY ROAD AS PRESENTLY ESTABLISHED. LYING AND BEING IN SECTION 9, TOWNSHIP 2 SOUTH, RANGE 24 WEST. The total actual acreage of the above- described property is approximately 0. 66 acres. At the time of the annexation, the property is vacant. Section 4. Effect of Annexation The area annexed shall be subject to all laws, ordinances, and regulations in force in the City of Fort Walton Beach and shall be entitled to the same privileges and benefits as other parts of the City of Fort Walton Beach -upon the effective date of the annexation, The City of Fort Walton Beach is electing to provide all necessary services, including those of the Ocean City - Wright Fire Control District. The area annexed is subject to the Okaloosa County Comprehensive Plan and zoning regulations. Said regulations shall reinain in full force and effect until the subject property is designated into a City of Fort Walton Beach Comprehensive Plan Future Land Use Map designation and rezoned accordingly in the City of Fort Walton Beach zoning map. Section 5. Municipal Boundary The municipal boundary lines of the City of Fort Walton Beach shall be amended to include the annexed property described in this ordinance and in the attached '*Location Map," Section 6. Effective Date This ordinance shall take effect immediately upon adoption on second reading by City Council and the signature of the Mayor. Adopted: Richard A.
