BOARD OF COUNTY COMMISSIONERS
AGENDA REQUEST
DATE: October 15, 2013
TO: Honorable Chairman and Members of the Board
FROM: John Hofstad
SUBJECT: Public Hearing: Right of Way Vacation 5th Ave and 5th St Port Dixie
DEPARTMENT: Public Works
BCC DISTRICT: 2
STATEMENT OF ISSUE: Watree Construction and Land Developing, LLC is petitioning the
Board of County Commissioners to vacate a portion of 5th Ave and 5th St rights-of-way Port
Dixie Subdivision of the Shalimar area.
BACKGROUND: Portions of 5th Ave. and 5th St. rights-of-way were previously vacated by
Resolution 06-128. The petitioner, Donald L. Roberts, specifically described that portion of 5th
Ave right-of-way lying adjacent to Lots 1-5, Block 49 and that portion of 5th St. right-of-way
lying adjacent to Lot 1, Block 49, Port Dixie Subdivision in his approved request.
Watree Construction is petitioning the Board of County Commissioners to vacate those portions
of 5th Ave and 5th St that were not described in the previous vacation request. If approved this
additional vacated right-of-way will give Watree Construction a 20'x20' area on the southwest
corner of the parcel and a 20'x10' area on the northwest corner of the parcel. See the attachments
for clarity of right-of-way areas requested for vacation. The existing stipulation on Resolution
06-128 will remain on all vacated rights-of-way.
OPTIONS: Approve/Disapprove vacation of right-of-way.
RECOMMENDATIONS: Approve the right-of-way vacation request from Watree
Construction and Land Developing, LLC.
