l ORDINANCE 1877 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FORT DISPOSITION WALTON BEACH, FLORIDA, AMENDING CHAPTERS 1, 8, AND 9 OF THE LAND DEVELOPMENT CODE IN ORDER TO DISSOLVE THE BOARD OF ADJUSTMENT AND ASSIGN ADDITIONAL DUTIES AND RESPONSIBILITIES TO THE LOCAL PLANNING AGENCY; AND PROVIDING AN EFFECTIVE DATE - - - - - -- r-- NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ! -- ----- - - - - -- FORT WALTON BEACH, FLORIDA AS FOLLOWS: - THE LAND DEVELOPMENT CODE OF THE CITY OF FORT WALTON BEACH IS AMENDED AS FOLLOWS: Section 1. Authority and Intent The authority for enactment of this ordinance is contained in Chapter 166. 021, 163. 3202, and other provisions of the Florida Statutes and section 2 of the City Charter. Section 2. Amendment of Chapter 1 Sections 1. 06.03, Local Planning Agency ( LPA), 1. 06. 04, Board of Adjustment ( BOA), and 1. 08. 01, List of Acronyms, of the Land Development Code, are hereby amended as depicted in the attached strike- through/ underline exhibit, " Chapter One - General Provisions." Section 3. Amendment of Chapter 8 The following sections of the Land Development Code are hereby amended as depicted in the attached strike -through/ underline exhibit, " Chapter Eight - Variations from Standards in the LDC ": Section 8. 00.01, Waiver of Standards Pertaining to Metal Buildings Section 8. 01. 07, Expansion or Modification of Detrimental Nonconforrnities Section 8. 02. 02, Required Findings for a Grant of Variance Section 8. 02.03, Procedures for Variances Section 8. 02.04, Appeal of Board of Adjustment Decisions Section 8. 02.06, Specific Requirements for Variances in Areas of Flood Hazard Section 8. 03. 01, Applicability Section 8. 03. 03, Filing an Appeal of an Administrative Decision Section 8. 03. 04, Stay of Work Section 8. 03. 05, Procedures for Consideration of an Appeal of an Administrative Decision Section 8. 03. 06, Appeal of Board of Adjustment Decisions Section 8. 04. 03, Procedures for Administrative Waivers Section 4.
