RE: Two Ordinances Amending Provisions regarding Wreckers
2005 Update and Recodification
I " 11 A - I" 1 t J?
Explanation:
Over the past year, concerns have arisen regarding amendments to
Chapter 38, our
current wrecker operations regulations. The current Code
provisions set out the conditions and
administration of the City' s wrecker rotation program. It does not regulate in any manner
conditions of wrecker operations other than those involved in the rotation
program.
Section 166. 043, Florida Statutes, requires that the County establish maximum rates
charged by wreckers for private tows and rotation program tows. However, those maximum rates
do not apply within the municipality. Complaints have been lodged with the Police
Department
regarding wrecker fees and access to stored vehicles. The complaints arose from private tows
and rotation tows.
I am presenting two ordinances for Staff and Council consideration. Ordinance A
simply
cleans up the provisions we have now without any substantive changes. Ordinance B cleans
up
the current provisions but also would enact the maximum regulation of wrecker that is
operations
allowed under the Florida Statutes.
