3. 00. 00 GENERALLY
3. 00.01 Purpose and Intent
The purpose of this chapter is to protect the existing natural resources in the City. These
standards preserve the natural environment, and protect wildlife habitat and migration
corridors.
3. 00. 02 Applicability
The standards in this chapter shall apply to all new development and redevelopment within
the City, except for development on lots of record that were approved for single- family
residential use prior to the effective date of this LDC.
3. 01. 00 FLOOD DAMAGE PREVENTION
3. 01. 01 Statement of Purpose
It is the purpose of this section to provide regulations intended to save lives, promote the
public health, safety and general welfare, and minimize public and private losses due to flood
conditions in specific areas. The regulations are provided specifically to:
A Restrict or prohibit uses which are dangerous to life, health, safety and property due
to water or erosion hazards, which result in damaging increases in erosion or in flood
heights and velocities;
B. Require that uses vulnerable to floods including facilities which serve such uses be
protected against flood damage throughout their intended life span;
C. Control the alteration of natural floodplains, stream channels, and natural protective
barriers which are involved in the accommodation of flood waters;
D. Control filling, grading, dredging and other development which may increase erosion
or flood damage; and
E. Prevent or regulate the construction of flood barriers which will unnaturally divert
floodwaters or which may increase flood hazards to other lands.
3. 01. 02 Objectives
The objectives of the regulations in this section are to:
A. Protect human life, health and to eliminate or minimize property damage;
B. Minimize expenditure of public money for costly flood control projects;
C. Minimize the need for rescue and relief efforts associated with flooding and generally
undertaken at the expense of the general public;
D. Minimize prolonged business interruptions;
E. Minimize damage to public facilities and utilities such as water and gas mains,
electric, telephone and sewer lines, roadways, and bridges and culverts located in
floodplains;
F. Maintain a stable tax base by providing for the sound use and development of flood
prone areas in such a manner as to minimize flood blight areas; and
G. Ensure that potential homebuyers are notified that property is in a flood hazard area.
3. 01. 03 Applicability
The provisions of Section 3. 01. 00 shall apply to all areas of special flood hazard within the
City.

3. 01. 04 Disclaimer of Liability
The degree of flood protection required by this section is considered reasonable for
regulatory purposes and is based on scientific and engineering consideration. Larger floods
can and will occur on rare occasions. Flood heights may be increased by man -made or
natural causes. These regulations do not imply that land outside the areas of special flood
hazard or uses permitted within such areas will be free from flooding or flood damages.
These regulations shall not create liability on the part of the City or by any officer or
employee thereof for any flood damages that result from reliance on these regulations or any
administrative decision lawfully made hereunder.
3. 01. 05 Basis for Establishing the Areas of Special Flood Hazard
The areas of special flood hazard identified by the Federal Emergency Management Agency
FEMA) in the Flood Insurance Study ( FIS) for the City dated December 6, 2002 with the
accompanying maps and other supporting data, and any subsequent revisions thereto, are
adopted by reference and declared to be a part of this LDC. The FIS and Flood Insurance
Rate Map are on file at Fort Walton Beach City Hall.
3. 01. 06 General Standards
In all areas of special flood hazard, all development sites, including new construction and
substantial improvements shall be reasonably safe from flooding, and meet the following
provisions:
A. New construction and substantial improvements shall be designed or modified and
adequately anchored to prevent flotation, collapse, and lateral movement of the
structure resulting from hydrodynamic and hydrostatic loads, including the effects of
buoyancy;
B. Manufactured homes shall be anchored to prevent flotation, collapse, and lateral
movement. Methods of anchoring may include, but are not limited to, use of over -
the -top or frame ties to ground anchors. This standard shall be in addition to and
consistent with applicable State of Florida requirements for resisting wind forces;
C. New construction and substantial improvements shall be constructed with materials
and utility equipment resistant to flood damage;
D. New construction and substantial improvements shall be constructed by methods and
practices that minimize flood damage;
E. Electrical, heating, ventilation, plumbing, air conditioning equipment, and other
service facilities, including duct work, shall be designed and /or located so as to
prevent water from entering or accumulating within the components during
conditions of flooding;
F. New and replacement water supply systems shall be designed to minimize or
eliminate infiltration of flood waters into the systems;
G. New and replacement sanitary sewage systems shall be designed to minimize or
eliminate infiltration of flood waters into the systems and discharges from the systems
into flood waters;
H. On -site waste disposal systems shall be located and constructed to avoid impairment
to them or contamination from them during flooding;
L Any alteration, repair, reconstruction or improvements to a building that is in
compliance with the provisions of this LDC shall meet the requirements of " new

construction' as contained in this LDC;
J. All applicable additional Federal, State, and local permits shall be obtained and
submitted to the Development Administrator along with the application for
development permit. Copies of such permits shall be maintained on file with the
development permit. State of Florida permits may include, but not be limited to, the
following:
1. The Northwest Florida Water Management District ( NWFWMD), in accordance
with Florida Statutes; and
2. The Florida Building Code.
K. Standards for subdivisions and new development
1. Such proposals shall be consistent with the need to minimize flood damage,
2. Such shall have public utilities and facilities such as sewer, gas, electrical, and
water systems located and constructed to minimize or eliminate flood damage;
and
3. Such proposals shall have adequate drainage provided to reduce exposure to flood
hazards.
L. When proposed new construction and substantial improvements are partially located
in an area of special Flood hazard, the entire structure shall meet the standards for new
construction.
M. When proposed new construction and substantial improvements are located in
multiple flood hazard risk zones or in a flood hazard risk zone with multiple base
flood elevations, the entire structure shall meet the standards for the most hazardous
flood hazard risk zone and the highest base flood elevation.
3. 01. 07 Specific Standards
In all A -Zones where base flood elevation data have been provided ( Zones AE, At 30, A
with base flood elevation), and AH), the following provisions shall
