MEMORANDUM
Robert T. Meams, City Manager
From: Michael Beedie, Engineering & Utility Services Director
Date: January 24, 2012
Subject: Discuss Draft Land Development Code Revisions
1. 1. On November 23, 2010, City Council approved the hiring of The Gal Easley Company
to revise the City' s Land Development Code.
1. 2. Over the past 12 months, the Land Development Code has undergone major revisions.
Each chapter has gone through several draft versions, incorporating public feedback
and Municipal Planning Board ( MPB) comments. Several public workshops and
meetings have been held to discuss the changes and solicit feedback.
2. DISCUSSION:
The entire Land Development Code has been restructured and reorganized. Inconsistencies
have been removed and the entire document has been streamlined to improve understanding
and readability. The attached document is a complete replacement of the current Land
Development Code ( instead of a strike -through/ undertine format). The following list contains
highlights and major changes for each chapter:
2. 1. Chapter I - General Provisions:
2. 1. 1. Land Development Code development review and enforcement responsibilities
were removed for the Community Redevelopment Agency and the Historic
Sites and Structures Advisory Board.
2. 1. 2. There were no major comments from the MPH or the public on this chapter.
2. 2. Chapter 2 - Zoning Districts and Uses:
2. 2. 1. The number of zoning districts was reduced from 26 to 11. Two large mixed -
use areas were established and the district boundaries were realigned for
consistency with the Comprehensive Plan. A new Zoning Map has also been
developed and will be adopted with the Land Development Code.
2. 2. 2. The maximum allowable density was increased in the residential and mixed -use
districts and the maximum allowable intensity was increased in the commercial
and mixed -use districts. A comparison table is attached.
2. 2. 3. The list of allowable uses was modified to be more comprehensive, yet
streamlined. Allowable uses were expanded for most zoning districts. A
comparison table is attached
2. 2. 4. Replaced the letter " C" in the uses table ( which stood for conditional use) with

the letter " S" ( stands for supplemental standards), which eliminates the
conditional use permit process. Using supplemental standards in these
categories removes the ambiguity in the decision- making process and creates a
clear distinction between what is allowed and what is not allowed.
2. 2. 5. Municipal Planning Board comments - there was some discussion regarding the
purpose and intent and that avoiding overcrowding should be emphasized as a
priority.
2. 2. 6. Public notices were mailed to every property owner that would receive a change
in zoning designation under the new LDC. Most of the comments received were
concerns over restricting property rights and commercial uses. Staff explained
during the public meeting that for most districts commercial uses will be
expanded under the new LDC.
2. 3. Chanter 3 - Environmental and Resource Protection:
2. 3. 1. This chapter has been reduced from 27 pages to 11 pages. The reductions
include removal of the ' Shoreline Protection Zone" and ` Restricted
Development Zone" provisions as well as streamlining the " Historic Sites and
Structures" section.
2. 3. 2. The former ` Shoreline Protection Zone" contained restrictions on building
within 50 feet of the shoreline, making waterfront development difficult. In the
revised LDC, appropriate shoreline setbacks have been maintained in Chapter 4
Development Standards) in the respective zoning districts, allowing suitable
water -dependent and water- related development along the shoreline.
2. 3. 3. The former " Restricted Development Zone" encompassed the area within 400
feet of any " shoreline protection zone" or " wetland protection zone" which
provided language regulating stormwater management, prohibiting septic tanks,
and providing for litter control. All of these items are contained in other
appropriate sections of the Land Development Code or Code of Ordinances.
2. 3. 4. The wetlands protection language has been modified to mirror the State of
Florida wetland protection regulations. The new language prohibits the dredging
or filling of any jurisdictional wetlands unless it is permitted through the State
of Florida or provided a de minimus exemption by the State.
2. 3. 5. The former " Historic Site and Structures- section, now called the " Historic and

Archaeological Resources" section has been significantly modified. The section
no longer contains a provision that demolition of any structure 50 years or older
requires a permit approved by the Historic Sites and Structures Advisory Board.
In addition, a survey will only be required if the site or structure is listed on the
Florida Master Site File or National Register of Historic Places. If any resources
are unearthed during development activity on any site in the City, development
shall be suspended until the City determines if a survey is needed.
2. 3. 6. Lastly, the flood damage prevention section has been updated to reflect the
latest model flood ordinance provided by the State of Florida and the National
Flood Insurance Program.
23.7. Major public comments received on this chapter included reducing the ability
for the Historic Sites and Structures Board to review
