HA: n1)7- G 1d + 1 21 - 0 ORDINANCE 1858 AN ORDINANCE OF THE CITY OF FORT WALTON BEACH, FLORIDA; REPEALING SECTION 5. 02.04, BIRD SANCTUARY, OF THE CODE OF ORDINANCES; AND PROVIDING AN EFFECTIVE DATE. Whereas, the City Council finds that Article IV, Section 9, of the Florida Constitution allows the Florida Wildlife Commission to regulate the management, protection, and conservation of wild animals and freshwater and marine aquatic life in the State of Florida, and Whereas, the City Council further finds that the Florida Wildlife Commission has enacted laws that adequately protect the interest ofbirds or wild fowl and their nests throughout the state and within the city limits of Fort Walton Beach, and Whereas, the City Council finds that it is necessary to amend the Code ofOrdinances. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WALTON BEACH, FLORIDA, AS FOLLOWS: Section 1. Authority & Intent. The authority for enactment of this Ordinance is section 166.021( 1) F. S. and the City Charter. Section 2. Amendment of Section 5.02. 04, Bird Sanctuary, of the Code of Ordinances. Section 5. 02. 04, Bird Sanctuary, of the Code ofOrdinances is hereby repealed. Section 3. Effective Date. This Ordinance shall take effect immediately upon approval on second reading by the City Council and signature of the Mayor.
