STATEMENT OF ISSUE: The Board of County Commissioners to conduct a public hearing
to consider adoption of an ordinance that will, if adopted, repeal and replace Sections 11.03.00
through 11.03.11 of the Land Development Code with a new Article VI of Chapter 11 of the
County Code pertaining to code enforcement, including the creation of provisions whereby the
County may utilize the non-ad valorem assessment collection process to recover the costs of
abating nuisance conditions on properties.
BACKGROUND: The Board of County Commissioners has directed staff to develop Code
revisions that would strengthen the County's code enforcement processes. Pursuant to this
direction Growth Management staff, in conjunction with the County Attorney, have developed
the attached ordinance which will, if adopted, authorize the County to collect the cost of the
abatement of nuisance code violations through the use of the non-ad valorem collection process
(referred to in the ordinance as a nuisance abatement assessment) as authorized under section
197.3632, Florida Statutes.
As discussed by the Board, the proposed ordinance clearly states that the decision to use the
nuisance abatement process is at the sole discretion of the Board of County Commissioners. The
ordinance also removes the code enforcement provisions from the Land Development Code, and
relocates them to Chapter 11, Health and Safety, of the County Code.
The Board of County Commissioners set the public hearing for this ordinance during its regular
meeting of November 3, 2015.
OPTIONS: The Board of County Commissioners may adopt, adopt with revisions, reject, or
table the proposed ordinance.
RECOMMENDATIONS: Staff recommends the Board conduct the public hearing and, after
consideration of the proposed ordinance and any testimony received, that the Board adopt the
proposed ordinance.
