BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: September 16, 2014 TO: Honorable Chairman and Members of the Board FROM: Sunil Harman SUBJECT: PFC Resolution and Assurances DEPARTMENT: Airport BCC DISTRICT: ALL STATEMENT OF ISSUE: The Board of County Commissioners is requested to adopt a Passenger Facility Charge Resolution required by the FAA for the approval of projects eligible for the use of these funds; and to assure, by certification, that it will comply with all provisions of Title 14 CFR Part 158 (Passenger Facility Charges). BACKGROUND: The attached resolution and assurances will be made part of an application for the approval to Impose and Use (I&U) PFCs for 19 projects at Okaloosa County's Airports. The Resolution authorizes the Airports Director to file the application and to carry out the administration of the PFC program. Attachment "A" lists the projects. PFCs are presently collected at the maximum rate of $4.50 per enplaned passenger. The collection period for the projects would begin on October 1, 2021, upon expiration of the current authorization, and end on January 1, 2030. Funds for these projects are available from PFCs already collected; hence the future collection period will provide funds for currently approved purposes such as repayment of bonds coming due in the future. PFCs are collected by the air carriers and submitted monthly directly to the airport. They are considered airport funds, but are subject to project approval and monitoring by FAA. Five of the 19 projects have already been completed, and approval is being sought to reimburse the County for the local matching funds expended by the Airport during construction. Total authority being sought is $14,628,493.00 which includes bond interest. Operating airlines have been consulted on the projects, as required, and their comments have been forwarded to the FAA. Attachment "B" is the required Certification of Assurances. Also attached for information is a description of each project and the Capital Plan summarizing the total funding by source for each project. Public comments were solicited for the required 30 days via both the Airport and County Web Sites. No public comments were received. OPTIONS: Approve, Disapprove or Table RECOMMENDATIONS: The Department of Airports staff recommends that the Board authorize the Chairman to sign the Resolution and the Assurances. RECOMMENDED BY: APPROVED BY: Ernie Padgett, County Administrator
