following findings of facts are recommended by staff regarding this subject request. One, the proposed planned unit development will promote more efficient and economic uses of land. And two, lower development and building costs are permitted, which will permit smaller networks of utilities and streets and there will be a use of more economic building types and shared facilities. Thirdly, it will provide for more open space and common areas and provide usable in suitably located recreational facilities within the development. Fourth, this project will allow the controlled development of land uses most suitable to the proposed site and surrounding neighborhoods. And fifth, it will provide design and location criteria to encourage innovative development. Ordinance 1762 if adopted would rezone the 36 parcels more Addition from Medium Density Residential to Planned Unit particularly described as New Germany Development. It will also replat the recorded subdivision and vacate Methodist Avenue accordingly. And also it will approve the Development Plan for Soundside affordable housing project. Resolution 2008- 36 will effectively vacate the New Germany Addition to accomplish this development request. 6 of 14 MUNICIPAL PLANNING BOARD MEETING 10- 2- 08 Samantha Abell - Staff respectfully recommends that the Municipal Planning Board find the request consistent with the Comprehensive Plan as an affordable housing project and forward to City Council its recommendation for approval of Ordinance 1762 and Resolution 2008- 36. The Municipal Planning Board may recommend to Council to approve the ordinance and resolution, recommend that Council approve the ordinance and resolution with changes, or recommend that Council deny ordinance 1762 and the resolution. At this time staff would like to enter the report into evidence, or into record. Janet Wilson - has the applicant seen the report? Okay, questions for staff from the Board. Mr. White Darryl White - and I'm not sure where to ask this, is there any way to help these guys out as far as the fees that they pay? Jim Tucker - Council can I Samantha Abell - you can make a recommendation to Council, there have been advertising costs. would ask the City Attorney to weigh in this because legally this is a quasi-judicial proceeding so we are very narrowed in scope as to what we are permitted to do. Tonight we should be making a recommendation based on these findings of facts. But I will say that there are a few things about this project that can be mitigated and that the purpose of the Planned Unit Development was for this to be more economically feasible. Unfortunately we cannot control the larger issues in the market. And also the CRA District, which this project is inside the CRA, but the applicant has been working with our Community Redevelopment Agency for amenities for this project and they' re continuing to work on that. And the applicant may want to speak to that. But we are working with him to offer some of those amenities such as lighting, crosswalks, and things like that. Janet Wilson - thank you, any other questions for staff from the Board. City Attorney - you need to submit the staff report Samantha Wilson - I did Janet Wilson - yes she did City Attorney - can I get a copy of all the DRC memos? Are there any objections to the staff report? There was none) Janet Wilson - do you want to call out your DRC members? City Attorney - yes, we' ll do that and these memoranda are actually in your packet as well if you want to follow along. But I'll try to make it as quick as possible. Mr. Murray yours is the first one if you could come forward. State your name and your relationship for the City. Thomas Murray, Public Works Director. City Attorney - and your memorandum is dated July 11, 2008. Tom Murray - yes 7 of 14 MUNICIPAL PLANNING BOARD MEETING 10- 2- 08 City Attorney - what day was the DRC meeting held? Tom Murray - I don' t recall City Attorney - would it have been within the same timeframe of July 2008? T om Murray - in that general timeframe I would expect. City Attorney - is the memorandum that you have in front of you with that July date, is that the only memorandum that you submitted as a DRC member? Tom Murray - to my recollection it is. City Attorney - was there anything in this memorandum, to your knowledge, that has not been satisfied with the current plan and the PUD document that we have under review? And that may have been poorly asked so if you want to answer it better than I asked it, that' s okay. Tom Murray - I'm just reviewing over this, to give you an exact answer I would have to go back and verify against the documents everything has been satisfied as a document presented to this fact finding committee, this is the, these are the comments on the conformance to our Code requirements that I submitted. City Attorney - thank you Tom Murray - okay that's all? City Attorney - that' s all, and you can leave, unless the Board has any questions for you. The next one is Mr. Beedie. If you could state your name and your position with the City. Michael Beedie, City Engineer. City Attorney - and were you the City Engineer on July 10th? Michael Beedie - no I wasn' t City Attorney - what was your job then? Michael Beedie - Utilities Operations Manager City Attorney - and do you have a copy of your July 10 memorandum? Michael Beedie - yes I do City Attorney - is this the memorandum you filled out for the Development Review Committee? Michael Beedie - yes 8 of 14 MUNICIPAL PLANNING BOARD MEETING 10- 2- 08 City Attorney - to your knowledge, if you know, have all of the items that are in your memorandum been addressed or at least told to the applicant? Michael Beedie - yes they have City Attorney - do you recall the date of the DRC meeting? Michael Beedie - actually I think the original meeting was in February and then we had a rezoning request, which is what this, my memorandum is from, so I don' t know if that' s actually considered a DRC or not but this memo in this packet is from that rezoning request. City Attorney - okay thank you. We' ll skip the next one I believe, Mr. Murray if you would come back up and just put this on the record. Is John Geurin still employed with the City? Tom Murray - Thomas Murray, Public Works Director, John Geurin is no longer with the City. City Attorney - okay thank you. Mr. Foley Malcolm Foley, Zoning & Building Supervisor City Attorney - and are you generally in charge of the Development Review Committee? Malcolm Foley - yes ma' am I am City Attorney - and were you in charge for the meeting regarding the rezoning application? Malcolm Foley - there were two meetings actually, the July 10, 2008 meeting was held by the DRC City Attorney - and then there was also a February meeting? Malcolm Foley - and there was a February meeting at the very beginning is where most of the issues arose that we had problems with. City Attorney - and as the kind of lead on that committee, you' re familiar with Mr. Geurin' s memorandum? Malcolm Foley - I'll have to read it again City Attorney - this one that I'm looking at that' s submitted in the record is February 8, 2008 Malcolm Foley - yes City Attorney - that' s the memo that he submitted for the DRC meeting? Malcolm Foley - yes it is 9 of 14 MUNICIPAL PLANNING BOARD MEETING 10- 2- 08 City Attorney - and to your knowledge have the issues in this memorandum been addressed by the applicant in the documents that we' re reviewing today? Malcolm Foley - to the best of my knowledge yes City Attorney - okay, and your memorandum, I believe the one that' s in the record is dated February 14 Malcolm Foley - yes City Attorney - and is that the memo that you submitted for the DRC? Malcolm Foley - yes it is City Attorney - and likewise have all of your issues been addressed by the applicant? Malcolm Foley - yes and actually that kind of leads us into what took so long, if you really look at my memorandum. If you all will remember when they first came forward the Housing Authority thought that they owned the park and realized they didn' t when they couldn' t produce the deed for it. And then when we looked at the plat it was actually on the plat as a park, and then we went uh oh they don' t own the park and the City owns it and they are either going to have to get the City to give it to them and I think its 2. 0 acres which means they got about 30 units out of that park parcel. And there was a Comprehensive Plan issue there because the park was actually on the Comprehensive FLUM map as park and recreation which means it wasn' t permitted to be multifamily. So then we had to go to the Planning Board and Council to do a Comp Plan amendment, then we had to figure out how to do a rezoning. In the middle of all that we discovered that, we wanted this project to go forward as fast as possible but it was zoned R-2 which was multifamily medium density which allow 13 units per acre, uh 15. The 15 units per acre met the Comprehensive Plan but because the park was a park you couldn' t build on it. So, beside the issue with the School Board stuff we had to push this through as fast as we could, do a Comp Plan amendment, do a rezoning, figure out how to abandon all the lots, how many lots are there? 43 lots? Lloyd Strickland - 34 Malcolm Foley - 34 lots, there' s 34 lots in that subdivision with all easements all over the place. Interior lines, we had City streets, public roads, right- of-ways, infrastructure, sewer lines, water lines, we had stuff everywhere. We were like, how are we going to do this, it' s impossible. So, in my memo I was going just let's replat the whole thing. Just replat it all, get Council to put the money where their mouth is, give them the park, push affordable housing forward, say here you go, we' re giving you some land, let's do it, and how fast can we do it, six months. City Attorney - Mr. Foley Malcolm Foley - sorry, I'm up here on my soapbox City Attorney - all those issues Malcolm Foley - I agree, this is my memo and we did it as fast as we could 10 of 14 MUNICIPAL PLANNING BOARD MEETING 10- 2- 08 City Attorney - Mr. Foley thank you. None of those decisions were made within the DRC meeting of February 14, 2008 right? Malcolm Foley - no ma' am they were not City Attorney - okay, they were subsequent decisions that staff and with my involvement as well on some of them Malcolm Foley - yes City Attorney - okay, thank you. I think you' re missing one other. Do you have Ms. Carnley' s memo from February? Malcolm Foley - yes I do City Attorney - okay and we' ll Malcolm Foley - I have my acting Building Official, Linda Carnley is no longer with the City of Fort Walton Beach. City Attorney - okay Malcolm Foley - he may address that memo or I can for you. Mr. Tim Bolduc is now the acting City Building Official Glenda Glover - where' s Ms. Camley? Malcolm Foley - Ms. Carnley retired Ms. Mayor City Attorney - okay since, it actually has a different date on it so instead of Mr. Bolduc doing it can you, why is this one dated January 25, 2008? Malcolm Foley - let me see, I have my attendance for the 10t\
