MAYOR/COUNCIL ANNOUNCEMENTS
Mr. Hartwell requested that an item be placed on the February 26 Council agenda to request
that the Finance Director report to Council the findings of inquiry into activities involving the
Presidio invoices and payments.
Mr. Hartwell also discussed an e- mail from the Finance Director referencing her not being able
to contact the City' s Labor Attorney directly by the City Manager, and questioned whether the
City Manager can direct how and when a Charter Officer of the City can contact the Labor
Attorney.
The City Attorney added that the Labor Attorney is the only one who would determine whether
he represents the City.
The City Manager advised the Labor Attorney works and represents the interest of the City and
individual employees do not have an inherent right per the personnel policy to contact the labor
attorney directly. She explained if there is a grievance, the employee goes through the Human
Resources Director, who hears the issues and shares them with the labor attorney. She
suggested the labor attorney contact Council about this particular issue as he has an opinion he
would like to share on this matter and he can do that collectively or individually.
Dr. Pullen moved to suspend Roberts Rules of Order during this discussion. Mr. Miller
seconded motion and it failed by a vote of 4 to 3 with Miller, Garvie, Pullen, and Hartwell in favor
and Holmes, Reeves, and Minich opposed. The Mayor Pro Tem advised that a 2/ 3, 5 to 2 vote,
is needed to suspend the rules. He further advised that any actions a councilmember may want
the Council to consider is to be placed on the agenda, and when he is chairing a meeting, he as
Mayor Pro Tem will overrule anything that is not an agenda item.
