ENGINEERING SERVICES FOR WASTEWATER TREATMENT EVALUATION
Staff requests Council authorization to award consulting
engineering services to the top- ranked
firm, Hatch Mott MacDonald LLC of Panama City, Florida at a cost not to exceed $ 75, 000 for a
Wastewater Treatment Evaluation study as defined in RFP 08- 109.
John Hofstad, Utilities Director, advised that in November 2007
City Council authorized Staff to
solicit proposals from qualified
engineering firms to perform a evaluation of a
comprehensive
Wastewater Service Agreement prepared by the County for treatment of the
City' s wastewater
flow at a cost not to exceed $ 75, 000. Mr. Hofstad informed that seven firms submitted
proposals for the work, and from those seven firms, a selection committee chose the top four,
conducted interviews, and chose Hatch Mott MacDonald LLC as the top- ranked firm.
Mr. Hofstad advised a representative of Hatch Mott MacDonald LLC was
present to answer any
questions that Council might have.
Council received clarification that in a qualifications based selection in the State of Florida,
selections are based on qualifications not on price, and it is up to Staff to
negotiate at or below
the budgeted amount, and if unsuccessful, negotiations will with the
begin second- ranked firm,
until a firm is found willing to provide services outlined for the dollars allowed in the
budget.
Also discussed was the fact that both the consulting firm and the law firm are included in the not-
to- exceed cost of $75,000. 00.

WASTEWATER STUDY (CONT) ,~...~
Council questioned if there was any idea as to what the cost of the services might be. Mike
Tatum, Purchasing Director, explained that Florida Statutes 287. 055, Competitive Negotiations
Act, states that price cannot be discussed; that hiring is done strictly by qualifications according
to the budget. Mr. Tatum continued that if a price cannot be negotiated with the top- ranked firm,
negotiations will begin with the second- ranked firm, and so on until an agreement is met.
The City Manager added that as a local government, the City' s budgets are public record and
f"""
the documents are available, so engineering firms do have access to that information and are
aware of the dollar amount.
The City Attorney received clarification that her services, as well as those of the bond attorney,
are included in the amendment.
The Mayor Pro Tem called for the vote on the amendment and it carried by a vote of 4 to 2
with Miller, Garvie, Pullen, and Hartwell in favor and Holmes and Reeves opposed.

not to exceed price with the selected firms, Staff will come back to Council and ask for a revised
