CITY OF FORT WALTON BEACH
MEMORANDUM
To: Joyce Shanahan, City Manager
From: John Hofstad, Utilities Director
Date: October 18, 2005
Subject: Sprayfield License Renewal with Eglin Air Force Base
BackgJ'ound:
The City of Fort Walton Beach owns and operates a wastewater treatment plant (WWfP) located at
1954 Percy L. Coleman Road. This facility, in operation since 1979, treats all of the sewage
in the to a standard consistent with the requirements of the Horida Department of
City
generated
Environmental Protection. Once treated, the liquid byproduct, or effluent, is safely dispersed to a
limited-access effluent sprayfield adjacent to the City' s WWfP. The City' s sprayfield is a 490- acre
parcel owned the Federal
by and managed by the Department of the Air Force.
government
Discussion:
Prior to 2000, the City leased the sprayfield property free of charge from the Department of the Air
Force. the late 1990s, the government changed its policy for leasing Federal property in an
During
the country. The City, along
attempt to recover " fair market value" for all land leased throughout
with other communities, appealed this decision and the Department of the Air Force responded by
offering each government agency lease holder the option to convert their existing lease to a real
estate license. The real estate license slightly differs from a lease in that the term is restricted to five
the Federal government. However, the real estate
years and the license can be tenninated at will by
license does not have an associated annual charge for the use of the property.
The City entered into an initial agreement with the Department of the Air Force for a real estate
license for the effluent sprayfield for a 5- year term effective October 20, 2000. This license is due to
expire this month and the City, along with Eglin Air Force Base, is in the process of the renewing
the license for another 5- year term. Staff recently received the sprayfield license renewal agreement
and a copy of the agreement is attached with this report for review by Council. The conditions of
the license are consistent with the City' s use of the property and Staff believes it is in the best
interest of the to renew the license as revised and negotiated by the City Attorney for another 5-
City
year term.

Recommendation:
Staff requests Council approval of the
Department of the Air Force real estate license agreement for
the continued use of the 490- acre effluent
