WAIVER OF ENVIRONMENTAL BASELINE SURVEY (EBS) License Renewal for the Fort Walton Beach City Spray Field RCS 05- 654 CERTIFICATION The 96 CEG/CERR proposes to grant a license renewal to allow the city of Fort Walton Beach to' continue to use 488 acres of Eglin property for an effluent spray field. This action allows the city of Fort Walton Beach to continue to utilize the spray field for sewage effluent disposal. The license renewal is needed to allow the city to continue to conduct safe operations of the city' s wastewater treatment facility. Property is located north of Lewis Turner Blvd on the Eglin reservation. This action is recommended for a' waiver of an EBS. Changes in land use have not occurred, nor will any land use changes result from the renewal of this license. 96 CEG/ CEVSP has conducted an initial record review, personnel interviews and a site visitation to detennine that there are no potential sources of contamination. Also the proposed license amendment area has been examined to determine the following: I. The condition of the property will not create health or safety risks when used as intended. 2. The allowable activities will not introduce hazardous materials or petroleum products on the property. 3. No material alteration or change in the physical condition of the property will occur if the property is held by the Air Force, such that the Air Force could be deemed an owner/ operator of the facility under the Comprehensive Environmental Response, Compensation and Liability Act. The above described property use meets the conditions identified in Section 1. 5. 2 of the Air Force Instruction 32- 7066, 25 April 1994, and thereby qualifies for this waiver ofEBS. The infonnation contained within this waiver report is based on records made available and, to the best of my knowledge, is correct and current as of 13 September 2005. It was deeded in fee simple to the City of Fort Walton Beach in 1990 and is approximately 660 feet long. Although the south portion of Stokes Avenue does have an asphalt surface, the paving was not built to City street construction standards. It will have to be removed for utility installation and will be properly reconstructed through the proposed Special Assessment District. Stokes Avenue presently serves approximately nine ( 9) businesses and undeveloped industrial properties. Water service for the existing businesses is nom the City' s water main on Lovejoy Road. The businesses use septic tanks for sewage disposal. No further development is possible along Stokes Avenue until adequate water, sewer, street and drainage improvements are provided in Stokes A venue. Stokes Avenue property owners requested the City construct the necessary water, sewer, street and drainage improvements for Stokes Avenue. On August 23, 2005, City Council declared a Special Assessment District for the water, sanitary sewer, street anddrainage improvements on Stokes Avenue. Choctaw Engineering, the engineering firm for this project, has prepared construction plans and specifications for these improvements. Plans for street construction include a 26 feet wide street with flat curb, drainage swales, stormwater retention area, and a vehicle turnaround. Utility construction includes an 8" water main with fire hydrants and taps for future connections and an 8" gravity sanitary sewer main with taps for future connections. The street and drainage construction will be done by a licensed contractor and the water and sewer construction will be done by City crews. City Staff met with Stokes Avenue property owners on March 17, 2005; May 25, 2005; and August 9, 2005 to discuss the assessment costs and the assessment process. At these meetings, the property owners reiterated their need for these improvements, although some were concerned about the amounts and distribution of the assessments. The estimated street and drainage costs are based on the construction bid received on July 26, 2005. The estimated water and sewer costs are based on the construction estimate for city crew construction. PH- s 1--- I On September 13, 2005, City Council approved Resolution 05- 32, which set a Public Hearing for October 25, 2005 at 7: 00 PM ( or as soon thereafter as the issue may be heard) at the City Council Chambers, at which the property owners that are to be assessed and the public may be heard regarding " the propriety and advisability of making such improvements." As approved by Council in Resolution 05- 32, the Preliminary Assessment Roll levies water and sanitary sewer assessments on a square footage basis and levies street and drainage on a front footage basis. The Preliminary Assessment Roll is based on an estimated total project cost of 228, 018. 08, which includes construction costs, contractual engineering costs, pennit fees, City Staff costs and City Attorney costs. The Preliminary Assessment Roll also shows the assessments payable in twenty annual installments at 5% interest per annum. ( The Florida Statutes allow up to a thirty year period at 8% interest. The proposed payment period and interest rate are the same as established for the 2002 Girard Avenue assessment.) Discussion: Pursuant to Chapter 170. 08 of the Florida Statutes, the City Council shall conduct a Public Hearing at which the property owners that are to be assessed and the public
