BACKGROUND: The FDOT has identified $3,804,231 of aviation and road money to assist in funding the estimated $11,000,000 project to construct a new entrance road from SR 90 northward to the John Givens connector road to the Airport. Although the majority of the funding is identified in Fiscal Years 2016, 2017 and 2018, the Joint Participation Agreement (JPA) has been approved for deferred reimbursement. This approval means that work can begin before funds are appropriated, but reimbursement will not be made until those years in which the funds are officially available. According to the JPA, County participation is estimated at $911,056 from Airport funding, and $6,234,177 will be requested from the FAA under Airport Improvement Program entitlement or discretionary funding. Total project cost currently is estimated at $10,949,464.00. OPTIONS: Approve, Table or Disapprove. RECOMMENDATIONS: Staff recommends acceptance of the deferred reimbursement JPA and authorize the Chairman to sign by approval of the attached Signature Resolution. BACKGROUND: The County has previously approved the solicitation of an underwriter and bond counsel with the intention of issuing refunding revenue bonds. The bonds are to be used to finance the refunding of the current Series 2003 airport revenue bonds and repayment of a "bridge" loan from the Florida Association of Counties used to finance the construction of projects at Northwest Florida Regional Airport and Bob Sikes Airport. This Resolution formally authorizes the sale and refunding. Attached hereto are drafts of the Preliminary Official Statement (POS) and the Third Supplemental Indenture required by the Securities and Exchange Commission (SEC) which disclose and require continuing disclosure of pertinent financial and operational information about the Airport of interest to potential bond purchasers. Also attached is an Escrow Deposit Agreement with The Bank of New York Mellon Trust Company which serves as the Trustee and Escrow Agent for the bonds, and a Bond Purchase Contract with the Royal Bank of Canada, the authorized underwriter for the sale, which company agrees to purchase the bonds for resale to the public. In addition, the Board is requested to approve the holding of a public hearing on November 5, 2013, to consider adoption of a resolution to approve the issuance of the Refunding Bonds (Series 2013) a portion of which will be used to repay a commercial paper loan from the Florida Association of Counties. A portion of that loan was used to finance facilities to be used by private parties, so Section 147(f) of the Internal Revenue Code of 1986 requires satisfactory documentation and approval of bond counsel as to the tax-exempt status of any or all of the proposed Series 2013 Bonds in a public forum. OPTIONS: Approve, Table or Disapprove RECOMMENDATIONS: Airport staff and Bond Counsel recommend approval of the Resolution and the scheduling of a Section 147(f) Public Hearing on November 5, 2013. BACKGROUND: The Economic Development Ad Valorem Tax Exemption is an incentive program in which Okaloosa County voters authorized the board to grant qualifying businesses an exemption in their county property taxes of up to 100 percent for up to 10 years. This program was initially approved by voters in 1981 and renewed in 1992. In September 2002, voters rejected the program. In March 9, 2004 voters approved the revival of the program. Per Section 3, Article VII of the State Constitution: (c)Any county or municipality may, for the purpose of its respective tax levy and subject to the provisions of this subsection and general law, grant community and economic development ad valorem tax exemptions to new businesses and expansions of existing businesses, as defined by general law. Such an exemption may be granted only by ordinance of the county or municipality, and only after the electors of the county or municipality which is voting on such question in a referendum authorize the county or municipality to adopt such ordinances. An exemption so granted shall apply to improvements to real property made by or for the use of a new business and improvements to real property related to the expansion of an existing business and shall also apply to tangible personal property of such new business and tangible personal property related to the expansion of an existing business. The amount or limits of the amount of such exemption shall be specified by general law. The period of time for which such exemption may be granted to a new business or expansion of an existing business shall be determined by general law. The authority to grant such exemption shall expire ten years from the date of approval by the electors of the county or municipality, and may be renewable by referendum as provided by general law. The authority to grant exemptions is set to expire in March 2014. The authority may be renewed for subsequent 10-year periods if each 10-year renewal is approved in a referendum. Florida Statute 196.1995 has been provided as Exhibit A. Cost analysis for a referendum by the Okaloosa County Supervisor of Elections is provided in Exhibit B. OPTIONS:
