RESOLUTION NO. 13-146
PUBLIC HEARING - REQUEST FROM MICHAEL MCARDLE TO VACATE A
PORTION OF THE ALLEY IN BLOCK 53, TOWNSITE OF PORT DIXIE
Mr. Stanford read the advertised legal notice for public hearing
to consider the request of Mr. and Mrs. Michael McArdle to
vacate a portion of the 10-foot east-west alley in Block 53 in
the Townsite of Port Dixie.
Portions of this alley were vacated by Resolution No. 09-43.
The McArdles’ requested vacation lies west of the previously
vacated right-of-way. Mr. Autrey reported a site visit revealed
an encroachment of an existing building into the unopened alley.
The vacation would resolve the encroachment issue. He advised
that if this request is approved, there will still be property
issues to be resolved with adjoining property owners. Mr.
Autrey showed photographs of the area, pointing out’ the
encroachments and the centerline of the alley. He stressed the
disputed property issues must be settled by the affected
property owners.
Mr. Robert Becker asked if the alley adjoining his property
could be vacated at this time. Mr. Autrey explained the public
hearing and consideration today is for a specific, advertised
portion of the alley. He told Mr. Becker he and others can make
a similar request.
Mr. James Wahl and Mr. Robert Wahl came forward and stated the
McArdles are their backdoor neighbors. Mr. Robert Wahl asked
what this vacation will mean for them. Mr. Amunds answered if
the request is approved, the vacated alley will be split with
the adjoin property owners. Mr. Autrey added that any deal the

Wahls make with the McArdles is a separate and private matter.
Mr. Dowd commented the Board will be divesting public ownership
if the vacation request is approved.
Upon inquiry by Mr. Rudy Archer, Mr. Autrey said the entire 20-
foot wide by 95-foot long portion of the alley was advertised
for vacation. If approved, the alley will be split down the
middle between adjoining property owners.
Mr. Parisot made motion, seconded by Mr. Boyles, to adopt a
resolution vacating the alley as advertised. 5 yeas.
RESOLUTION NO. 13-147
PUBLIC HEARING - ORDINANCE CREATING PARKVIEW ROAD TOWNHOMES MSBU
Mr. Stanford read the advertised legal notice for public hearing
to discuss adoption of an ordinance creating Parkview Road
Townhomes Municipal Services Benefit Unit (MSBU) for street
lights.
Mr. Autrey reported letters have been received from eight of the
ten property owners within the proposed MSBU boundaries
supporting creation of this request.
No one came forward to speak in favor of or in opposition to the
proposed MSBU. Mr. Parisot made motion, seconded by Mr. Boyles,
to adopt an ordinance creating the Parkview Road Townhomes MSBU.

13. Approval and authorization for Chairman to execute a
resolution to refund 2003 Airport Bond and a Florida Association
of Counties Commercial paper loan and schedule a related public
hearing
Mr. Parisot stated that he has spoken with Sunil Harman, Mark
Galvin, and Mark Mustian on this agenda item and said he would
like for it to be tabled. He recommended consideration be given
to bank financing rather than issuance of bonds, saying he
believes the county will save a substantial amount of money.
Mr. Amunds asked if there are any problems with pulling this
item from consideration. Mr. Sunil Harman, Airports Director,
requested the process continue and not be tabled. He advised
there are potential problems with seeking a bank loan because
the county does not own the property but has a 25-year lease.
Mr. Harman said he has also spoken with Mark Galvin, Financial
Advisor with First Southwest, and there is no certainty
commercial institutions will be interested. Further, he said it
would require a formal Request for Proposals (RFP) to obtain a
guaranteed proposal. Mr. Harman stated banks typically look at
a ten-year term while the bond issue would be for 17 years. He
noted there would also be closing costs and fees with a bank
loan.
Upon inquiry by Mr. Windes, Mr. Harman stated he has been in the
airports business for 26 years and has financed projects
totaling $4.5 Billion. Mr. Harris commented the county has
nothing to collateralize. Mr. Dowd said a statement was made
the bank would rely on the full faith and credit of the county
and that is not something we will give.
Mr. Boyles made motion, seconded by Mr. Windes, to approve Item
#13 and to provide staff with instruction to review
alternatives. Mr. Parisot expressed concern about the number of
blanks in the exhibits attached to the proposed resolution. Mr.
Mark Mustian, attorney with Nabors, Giblin & Nickerson, reported
this is a delegate award issue. The Chairman and Clerk will be
asked to sign documents when certain parameters are reached. He
advised a public hearing must be held because part of the bonds
were used for private purposes. Mr. Amunds commented that as
Chairman he will not sign anything until all blanks are filled
and the County Attorney reviews the final documents. 5 yeas.

#19. Request to rebid Misdemeanor Probation Services Contract
and appoint review committee
Currently, Judge Patterson Maney, Commissioner Parisot, and
Trial Court Administrator Robin Wright have been suggested for
the review committee. Mr. Parisot recommended Bill Bishop and
Tom Murphy be added to that committee. Mr. Parisot made motion,
seconded by Mr. Harris, to approve the recommendation to rebid
this item and to approve the review committee as outlined above.

#22. Award contract for State Lobbyist Services to the Advocacy
Group
Mr. Parisot stated the proposed contract with the Advocacy Group
is for one year with two optional one-year renewals. He said
they have worked for the county for three years and he sees
value in having a long-term contract. Mr. Parisot made motion
to amend the term of contract to three years with two optional
one-year extensions. Mr. Boyles stated he is more comfortable
with the one-year term and cannot support the proposed change to
the contract. Mr. Parisot pointed out there are still
provisions to terminate the contract even if it is changed to a
three-year term. Mr. Richard Brannon, Purchasing Director,
noted there is a cancellation provision with 60-days notice.
Motion dies for lack of a second.
Mr. Boyles made motion, seconded by Mr. Harris, to approve Item
#22 as presented. 5 yeas.
#23. Award contract to reroof the Tourist Development Welcome
Center
Mr. Amunds stated staff has requested this item be pulled from
consideration.
Mr. Harris made motion, seconded by Mr. Windes, to approve Items
#1 through #12, #14 through #18, #20, #21, and #24 through #27.
