BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: June 3, 2014 TO: Honorable Chairman and Members of the Board FROM: John Hofstad SUBJECT: Request to Vacate of a Portion of Railroad St Blk 9 Oakdale Mini Farms DEPARTMENT: Public Works BCC DISTRICT: 1 STATEMENT OF ISSUE: Mr. Richard P. Peterman, agent for Anchors, Smith and Grimsley, on behalf of their client, Gary McMorrow, is petitioning the Board of County Commissioners to vacate that portion of unopened Railroad Street bounded on the east by Lot 2, Block 9, Oakdale Miniature Farms, as recorded Plat Book 1, Page 129, of the Official Records of Okaloosa County, Florida and bounded on the west by right-of-way owned by the city of Crestview (Industrial Drive). BACKGROUND: The Oakdale Miniature Farms Subdivision was platted in October of 1946. The right-of-way in question was recorded as R. R. Street as part of the Oakdale Miniature Farms subdivision in Plat Book 1, Page 129, but improvements were never constructed. The requested right-of-way vacation is 44.29 feet wide on the south end and 49.35 feet wide on the north end, north to south distance is approximately 216 feet (see attached survey). If the vacation request is approved the vacated land granted to the applicant's parcel will be improved in association with development of the parcel. Public Works received a letter requesting the vacation of the unimproved R. R. Street right-of-way be made without any of the standard conditions that limit the use of the vacated right-of-way; except that a utility easement may remain in the westerly ten feet of the vacated right-of-way to protect any utility company that may have infrastructure in place. OPTIONS: Approve/Disapprove RECOMMENDATIONS: Approve for a Public Hearing to be scheduled for July 1, 2014 as requested. RECOMMENDED BY: APPROVED BY: Ernie Padgett, County Administrator
