RE: Biuewater Bay Development of Regional Impact (DRI) Crown Castle Development Proposal
File No. ADA-01-1977-003 Non-Substantive Modification
Dear Ms. Westine:
In your letter dated March 28, 2013, you request a determination of whether a proposed
change to the Bluewater Bay DRI may be reviewed and adopted as a non-substantial
amendment to the development order without the need for submittal of a notification of
proposed change (NOPC) pursuant to Section 380.06(19)(e)2., Florida Statutes (F.S.).
The proposed amendment wouid construct a 317-foot self-support iattice communication
tower and related facility on a 10,000 square-foot lease area located at 1050 Bay Drive,
Niceville, Florida, Parcel Identification No. 22-1S-22-0000-0001-0090. The proposed change will
not increase the number of external peak hour trips and will not reduce the amount of land set
aside for open space or conservation in the DRI. The site contains no wetlands or other natural
resources of significance.
Section 380.06(19)(e)2.k, F.S., states that changes that do not increase the number of
external peak hour trips and do not reduce open space and conserved areas are not substantial
deviations. The Department concurs that the construction of a communication tower described
above is eligible for consideration as a Section 380.06(19)(e)2.k, F.S. amendment. The
Department has consulted with Okaloosa County and the West Florida Planning Council
regarding the proposed change and neither has any objection to the conversion.

Therefore, pursuant to Section 380.06(19)(e)2.k, F.S., if Okaloosa County approves the
change it will not require the filing of a NOPC. The County must render the amended
Development Order to the Department once it is adopted. Thank you for the opportunity to
review this proposed change, if you have any questions, please contact Ana Richmond at
(850)717-8509.
