BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: April 7, 2015 TO: Honorable Chairman and Members of the Board FROM: Elliot Kampert SUBJECT: Destin West Dock Riparian Buffer Encroachment DEPARTMENT: Growth Management BCC DISTRICT: Commission District 2 - Commissioner Ketchel STATEMENT OF ISSUE: The Board of County Commissioners must decide whether it wishes to allow an encroachment into the 25 foot riparian interest buffer on the western edge of Beach Access 9. BACKGROUND: The Destin West Condominium has finished construction of a 29-slip, private docking facility to be used by residents and guests. The Condominium has obtained all necessary local, state, and federal permits and authorizations. However, during the final inspection conducted by the Florida Department of Environmental Protection (FDEP), it was discovered that the dock's wave attenuators and electrical circuit box platform intrude into the 25 foot riparian interest setback between the waterward extension of Destin West's property and the waterward extension of the County's Beach Access 9. As shown Attachment 3, the wave attenuators encroach by roughly 9 inches into the 25 foot setback, while the circuit box platform encroaches by approximately 7.8 feet into the setback. Neither the attenuators nor the platform extend over the County's riparian interest area (i.e., the area seaward of the Beach Access 9); in fact, there will be 17.3 feet between the furthest edge of the platform and the riparian extension of the property line between County-owned and Destin West properties. In addition to Growth Management, the Public Works Department has also reviewed the proposed encroachment and has no objections. In order for the docks to receive final approval from the FDEP, the Board must authorize the Chairman to sign the Letter of Concurrence for Setback Waiver. OPTIONS: The Board may authorize or not authorize the Chairman to sign the Letter of Concurrence for Setback Waiver. RECOMMENDATIONS: Staff recommends that the Board authorize the Chairman to sign the Letter of Concurrence for Setback Waiver, and that this letter be provided to the Destin West Bayside Property Owners' Association for transmittal to the Florida Department of Environmental Protection to enable final approval of the docks. RECOMMENDED BY: APPROVED BY: John Hofstad, County Administrator
