BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: February 19, 2013 TO: Honorable Chairman and Members of the Board FROM: Jeff Littrell SUBJECT: REPI Phase 3 Agreement Revision between OCWS and Air Force DEPARTMENT: Water and Sewer BCC DISTRICT: One STATEMENT OF ISSUE: Staff requests the Board of County Commissioners approve and re- execute the "Agreement for a Deed of Easement". This is a $200,000 grant to go towards land acquisition of a Shoal River buffer, which benefits both the Air Force (Duke Field flight path) and Okaloosa County (watershed protection for future water supply). BACKGROUND: This Agreement was unanimously approved by the BCC on Jan. 8, 2013. The Chairman then executed 3 original agreements, and it was forwarded to the Air Force for their execution. The Air Force has not yet executed the agreement because the name of one of their agencies changed. The Air Force Real Property Agency (AFRPA) is now the Air Force Civil Engineering Center (AFCEC). As such, the Air Force has requested we update the agreement and re-execute before they execute. This terminology appears once in the Agreement itself, and once in Exhibit C. OCWS staff has made these 2 changes. No other changes have occurred in the document. Attached for your review is the following: - Agenda Request from Jan. 8, 2013 - Agreement w/ Exhibits - County Contract Review Coordination Sheet - Map OPTIONS: Approve or deny. RECOMMENDATIONS: Staff recommends BCC approval for the Chairman to re-execute the "Agreement for a Deed of Easement" with the Air Force. Staff also requests that the BCC authorize the Chairman to execute subsequent funding related documents and any future modifications related to this Agreement. RECOMMENDED BY: APPROVED BY: James D. Curry, County Administrator
