Via Facsimile: 850.222. 2126 RE: Lamar Ine v. City Dear Jerry, The Council voted last night to hear argument/discussion from Lamar and City Staff regarding the proposed Modification to Settlement Agreement. Because of Staff leave, the matter will not be heard until the regular Council meeting on October 10, 2006. Please plan to make your client's in full at that point. My role in the hearing will be as Counsel for the City presentation Council. I have advised Staff that they should have Counsel to represent them as well and anticipate that they will procure the services of Mark Miller to represent them. The matter will be handled as a hearing, noticed accordingly, cross- examination permitted, and all quasi-judicial witnesses sworn. A court reporter will record the session. During that public session, Lamar will present its proposal and then Staff will present its suggested revisions to the The will then ask for any public input. Council will proposal. Mayor vote separately on each suggested revision after the conclusion of all testimony. Council has received for perusal a of the 2002 copy Lamar' s 2004 suggested amendments to our agreement, sign code, a copy of my letter to James Moore explaining the permit denial for the board at 252 Miracle Strip Pkwy, and your 2006 proposed Modification. To facilitate Council deliberation, Staff needs an electronic version of Lamar' s proposal so that can add line numbers for reference and make strikethroughs and additions as is customary they in documentary revisions at the local government level. If you have any questions, please contact me. Otherwise, I look forward to seeing in October. Thank you. Sincerely, Toni L.
