RE: Bluewater Bay Development of Regional Impact (DRI) Randy Wise Homes, Inc. Proposal
File No. ADA-01-1977-003 Non-Substantive Modification
Dear Mr. Rigby:
In your memorandum to the Department dated April 9, 2015, you share your request
made to Okaloosa County on March 6, 2015, to change land uses on approximately 10 acres of
the 5,714-acre Bluewater Bay DRI, which is located adjacent to and southeast of the Magnolia
Forest subdivision in Okaloosa County, Florida. The Department interprets your memo and the
information provided as a request for our determining whether the proposed changes to the
DRI may be reviewed and adopted as a non-substantial amendment to the Development Order
without the need for submittal of a Notification of Proposed Change (NOPC), pursuant to
section 380.06(19)(e)1., Florida Statutes (F.S.).
The proposed amendment would change 10 acres of the "golf" subcategory of Open
Space to seven acres of Medium/Low Residential and three acres to the Open Space
subcategory of "other open space" and shift 21 units from High Residential to this Medium/Low
Residential use. The information provided shows these modifications will have an insignificant
net increase in external peak hour trips (0.12 percent increase) and, individually or cumulatively
with any previous changes, will not reduce the amount of land set aside for open space (1.78
percent decrease) in the DRI in excess of the criteria in section 380.06(19)(1)(b)8., F.S.
Considering these modifications, the approved development plan would still have a pool of 263
authorized but not constructed residential units and 385 acres of open space (156 acres within
the "golf" subcategory) in excess of the amounts currently approved. There is no proposed
change to the DRI build-out date.
The Department agrees these modifications do not individually or cumulatively with
other changes exceed any of the criteria enumerated in sections 380.06(19)(b)1-10. F.S., and do
not constitute a substantial deviation or create the likelihood of additional regional impact.
Therefore, pursuant to section 380.06(19)(e)1., F.S., the proposed modifications do not require
the filing of an NOPC. The Department has consulted with Okaloosa County and the West

Florida Regional Planning Council and neither has any objection to the proposed modifications.
However, the amendment to the Development Order must be adopted in accordance with
Okaloosa County's procedures for amendment of a Development Order; and if adopted, the
County must render the amended Development Order to the Department.
Thank you for the opportunity to review this proposed change. If you have any
questions, please contact Mark Yelland, AICP, at (850)717-8517 or Sherry Spiers, R
