BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: March 3, 2015 TO: Honorable Chairman and Members of the Board FROM: Jason Autrey SUBJECT: Acceptance of amended easement for right-of-way DEPARTMENT: Public Works BCC DISTRICT: 1 STATEMENT OF ISSUE: Accept amended easement to remove a hiatus between the southerly right-of-way of Airman's Memorial Road and Partridge Hills Subdivision entrance. BACKGROUND: The Okaloosa County BCC at its regular Board meeting on November 7, 2006 accepted an easement for the purpose of road right-of-way, drainage, slope and utilities from Victoria of Northwest Florida Property South. The legal description of the said easement was described in Book 2747, Page 3948 of the Official Records of Okaloosa County. During the plat review of Partridge Hills Subdivision, a hiatus was discovered along the southerly right-of-way of Airman’s Memorial Road and adjacent to the north boundary of Partridge Hills Subdivision (between the right of way and the subdivision entrance). In order to provide a continuous access (or remove the gap) to Partridge Hills subdivision, the legal description of the original easement was amended to include the hiatus area. The owner of the property, Thomas L. Young Trust (also known as Victoria of Northwest Florida Property South - grantor of the original easement) executed the amended easement which was recorded in Book 3181, Page 3550 of the Okaloosa County Official Records. These were completed prior to the BCC approval of the plat. OPTIONS: Approve/Disapprove acceptance of the amended easement.
