Jd CITY COUNCIL OCTOBER 10, 2006 SUBMITTAL FOR PUBLIC RECORD STAFF REPORT AGENDA ITEM # 2 ORDINANCE 1707 AMEND FLUM FROM OKALOOSA COUNTY LDR TO FORT WALTON BEACH LDR 653 COUNTRY CLUB AVENUE NE q!- cA CITY OF FORT WALTON BEACH, FLORIDA MEMORANDUM To: Joyce Shanahan, City Manager Through: Missy McKim, Director, CD~ From: Len Mitchell, Planning Manager tHY' Date: September 8, 2006 Subject: Consideration of Ordinance 1707- Request for a Small Scale Amendment to the Future Land-Use Map for Kathi Thomas- Location is 653 Country Club Avenue NE. (MPB Case# 06- 24- CP) REQUEST: Small scale map amendment to the Future Land Use Map of Directions the Comprehensive Plan. The change requested is from Okaloosa County LDR ( Low Density Residential) to City of Fort Walton Beach LDR, Low Density Residential. The 0. 62 acre site is located at 653 Country Club Avenue NE The City will also process an amendment to the zoning map for a zoning district which is consistent with the LOR, Low Density Residential land use designation upon completion of the processing of this request. BACKGROUND: The request is the next step in the voluntary annexation process The process of amending the Future Land Use Maps of the Comprehensive Plan for a small scale amendment represent an alternative, more expeditious procedure to the twice- a- year limitation of regular plan amendments. Small scale amendments are limited to those sites, which are: 10 acres or less in area, have not filed an amendment within 12 months, are not within 200 feet of a property with the same owner and granted a change within the past 12 months, and are not located within an area of critical state concern The City of Fort Walton Beach is permitted 120 acres within a 12 months period as it meets criteria 1. a. having both a designated redevelopment area ( CRA) and has a Transportation Concurrency Exception Area ( TCEA) .The cumulative acreage for small scale amendments approved by the City within the current calendar year, including the request, is 0. 62 acres. The Munidpal Planning Board acting as the Local Planning Agency ( LPA) heard the request at a public hearing on September 7, 2006. There were no public comments either for or against 2 the request. The Board recommended approval of the request by a unanimous vote of 6- 0 Wayne absent). . The process requires that the amendment be adopted by Ordinance. The City Council will consider Ordinance 1707 on First Reading on Tuesday, September 26. 2006. If approved, . Council will consider the matter at an adoption public hearing on Tuesday, October 10, 2006. The proposed amendment will be transmitted to the Florida Department of Community Affairs. If an affected party requests no formal review within 30 days, then the proposed amendment will become effective 31 days after adoption. The City Attorney has reviewed Ordinance 1707 and found that it is in proper legal form. DISCUSSION: The City Council approved the applicant' s voluntary annexation request on June 27, 2006. The request site is developed as a single family residence and no further development is contemplated. The Staff Report with a detailed analysis of the impact of the requested amendment is enclosed. The reason that the proposed change in Land Use Designation is appropriate is that projections are changed in the comprehensive plan that affects boundaries of the Future Land Use Map. The property was annexed to the City in June 2006 and needs to be added to the City' s Future Land Use Map and designated for the appropriate land use. RECOMMENDATION: The Local Planning Agency found that the request is an appropriate change in the Future Land Use Map of the Comprehensive Plan and recommended that City Council approve Ordinance 1707.
