BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: October 4, 2016 TO: Honorable Chairman and Members of the Board FROM: Jason Autrey SUBJECT: FDOT Amendment to Traffic Signal Maintenance Compensation Agreement DEPARTMENT: Public Works BCC DISTRICT: ALL STATEMENT OF ISSUE: Florida Department of Transportation (FDOT) requests approval of the proposed Amendment to the Traffic Signal Maintenance and Compensation Agreement to the existing Traffic Signal Maintenance and Compensation Agreement. BACKGROUND: In 2015 the County entered into a maintenance agreement for traffic signals and devices along the state roadway system within the County in accordance with FDOT Contract #ARX44. This ongoing agreement with FDOT provides reimbursement to the County for the maintenance of signalized intersections and control devices as described in Exhibit A (device list) and Exhibit B (funding schedule). FDOT has issued an Amendment providing additional funding for damages not currently covered in the existing agreement, for interconnected signals and language to designate a person(s) to approve future annual Exhibit A’s containing the list of devices for reimbursement. The Amendment includes additional funding where damage is caused to Traffic Signals and Devices by a Force Majeure Event or as a result of other causes beyond the control of the Maintaining Agency and an additional $1,500 per intersection for signals connected to the advance traffic control system (45 signals for an increase of $67,500). The Amendment also includes language for the County to designate and authorize representative(s) to execute future Exhibit A's. Annually, FDOT provides a document listing intersection locations and compensation amounts as defined in the Agreement for our acknowledgment. This document will vary in future years to reflect changes in the number of devices and fee schedule changes as described in the Agreement. The Maintaining Agency designates Traffic Engineer, County Engineer or Public Works Director as its authorized representative(s), who is delegated the authority to execute any and all amendments to Exhibit A of this Agreement on behalf of the Maintaining Agency. The State requires the Amendment to the Traffic Signal Maintenance and Compensation Agreement be approved and signed. FDOT requires two original signed and dated documents. The Amendment has been through the internal review process, including review by the County Attorney, and the coordination review sheet is attached. OPTIONS: Approve/Not Approve the Amendment to the existing agreement between FDOT and Okaloosa County. RECOMMENDATIONS: Approve the Amendment to the Traffic Signal Maintenance and Compensation Agreement between FDOT and Okaloosa County. RECOMMENDED BY: APPROVED BY: John Hofstad, County Administrator
