governmental interest in the form of ensuring adequate right-of-way for future
widening or improvement projects, protecting the public safety by ensuring that
buildings do not become a hazard to either motorists or building occupants due to
proximity to the roadway, and providing a means to accommodate future growth
and development by ensuring adequate roadway and transportation corridors.
Policy 5.3.2 No portion of any building shall be constructed within an existing public
roadway except for those buildings or structures which functionally must be located
within a right-of-way (i.e. toll booth, weigh station, pedestrian overpass, etc.).
