Dear Chairman Amunds And Honorable Members of the Board of County
Commissioners:
SUBJECT: Petition to Vacant Right of Way
We very much appreciate your considering our request petitioning the County to vacate
the remaining 26’ x 180’ right-of-way known as the “45th Street right of way,” which lays
adjacent to our property line to the south.
The legal recording of our property Is:
Valparaiso Pinecrest, Addition #6

Plat Book 1, Page 50 of the Public Records of Okaloosa County Florida
Block 66, Lots 10, 11 and 12
Our street address is:
1734 Pine Avenue, Niceville, Florida 32578
We have resided at this address since May 1983, and have continuously maintained said
right-of-way since this time. We respectively request that the Board of Commissioners
grant and authorize us to proceed with the required process fo pursue the “vacation” of
the “15th Street right-of-way.” By doing so will permit us to erect a privacy fence on the
south side of our property.
We will abide by all required transactions to begin and complete this process, and will
abide by all Okaloosa County code regulations that pertain to the future maintenance of
said right-of-way.
Attached to our petition for reference and support are two documents: 1) an Invoice
showing that we have paid for the removal of trees on and/or near the 16th Street right-
of-way; and 2) a copy of Okaloosa County Resolution #95-93: “Vacation of Property”
vacated to M. Ann Newsome.

This property vacation adjoins said right-of-way, which is the subject of our request to
Petition. (Ms. Newsome’s Petition dated June 20, 1995 for a line of property, of the
unopened 16th street, (right- of- way, 25°x150’.)
We are extremely hopeful that our request will be considered in granting us approval to
move forward In the processing all the required notices and legal documents for the
“vacation “ of property governed by the Board of County Commissioners For Okaloosa
