BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: November 6, 2012 TO: Honorable Chairman and Members of the Board FROM: John Hofstad SUBJECT: Extension of Maintenance Bond for Mossy Oaks Plantation Phase 1 DEPARTMENT: Public Works BCC DISTRICT: Three STATEMENT OF ISSUE: The developer is requesting an extension of the maintenance bond (Irrevocable Standby Letter of Credit No. 226) for Mossy Oaks Plantation Phase I subdivision. BACKGROUND: Mossy Oaks Plantation Phase 1 subdivision was accepted by the Board to enter into the 18-month warranty period on January 11, 2011. The Irrevocable Standby Letter of Credit No. 226 in the amount of One Hundred Twenty Seven Thousand Dollars ($127,000.00) was provided by the developer to serve as maintenance bond. The letter of credit will expire on December 14, 2012 and numerous project deficiencies have not been rectified by the developer. The extension of the bond will give the developer additional time to correct the project deficiencies. The developer is requesting approval from the Board of County Commissioners to obtain an extension to the letter of credit so that they can perform the necessary repairs. If approval from the Board of County Commissioners is granted, the developer will have until November 28, 2012 to present the new letter of credit to staff for formal acceptance by the Board of County Commissioners at the next regularly scheduled meeting. Should the Board of County Commissioners deny the request for an extension the developer shall have until December 14, 2012 to perform all repairs or the County will act on the existing letter of credit. OPTIONS: Approve/Disapprove the developer’s request and authorize action on the letter of credit to perform the necessary repairs. RECOMMENDATIONS: Approve a one (1) year extension of the maintenance bond and require the developer to submit the extended bond on or before November 28, 2012. RECOMMENDED BY: APPROVED BY: James D. Curry, County Administrator
